RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA OPPOSING SENATE BILL 402: EMPLOYER-
EMPLOYEE RELATIONS
WHEREAS Senate Bill 402 would implement a state-mandated system of binding arbitration
for Police and Fire employees irrespective of the will of the citizens of Chula Vista; and
WHEREAS Senate Bill 402 would empower an arbitrator who does not answer to the City
Council or the people of Chula Vista to determine salary and benefits for Police and Fire employees
in Chula Vista; and
WHEREAS the passage of Senate Bill 402 will result in the loss of decision-making power
on public safety employee salary and benefits and will restrict the authority of locally-elected public
officials to respond to the specific needs and economic constraints of their specific communities; and
WHEREAS the passage of Senate Bill 402 would place as much as $3 billion of annual city
payrolls throughout Califomia under the authority of an outside arbiter; and
WHEREAS the passage of Senate Bill 402 will shift the ability to manage public safety
employees from the Police and Fire Chiefs to an arbiter who reports to no one when it comes to the
day to day hours and terms and conditions of how this City's public safety departments operate; and
WHEREAS a City of Anaheim study found that cities with a system of compulsory and
binding arbitration are, on average, 2 to 5 percent higher in wages than cities without such systems;
and
WHEREAS the premise that this bill would protect citizens from a public safety employee
strike is spurious in that existing Labor Code and court decisions already ensure that this cannot
happen; and
WHEREAS the loss of local discretion over dispute resolution will leave this city vulnerable
to the whims of outside authorities.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does
hereby strongly oppose Senate Bill 402.
