RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING ACTION OF THE SAN DIEGO CITY COUNCIL
IN ESTABLISHING "SPHERES OF INFLUENCE" FOR RESERVE
CAPACITY RIGHTS IN THE METROPOLITAN SEWER SYSTEM
AND COMMENDING SAID BODY FOR SAID ACTION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council of the City of San Diego by
Resolution No. 201547, adopted on December 29, 1970, has set forth
as Council policy restrictions on the "Spheres of Influence" for
reserve capacity rights in the Metropolitan Sewerage System, and
WHEREAS, said policy would require the approval of the City
Council of the City of Chula Vista for the exercise of capacity
rights in the Metropolitan Sewerage System by any public agency or
sanitation district within the "Spheres of Influence" for the City
of Chula Vista as delineated on the exhibit attached to the Council
policy Resolution No. 201547, and
WHEREAS, such a policy has long been urged by the City of
Chula Vista to protect capacity rights for which the taxpayers of
the City of Chula Vista have been paying and will continue to pay
for in the future.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve the action taken by the
San Diego City Council by Resolution No. 201547, adopted on December 29,
1970, and further agrees to fully support said policy and to work
closely with the San Diego City Council in promoting the mutual in-
terests of all participating members of the Metropolitan Sewerage
System.
BE IT FURTHER RESOLVED that the City Council does hereby
commend the City Council of the City of San Diego for their action
in expressing a renewed desire for such mutually beneficial coopera-
tion and does further express the hope and desire that such an
attitude of cooperation will continue and will extend to all areas
of mutual interest.
BE IT FURTHER RESOLVED that the City Council does hereby
adopt the same policy as heretofore adopted by the City Council of
San Diego as Council policy for the City of Chula Vista.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby authorized and directed to forward
a certified copy of this resolution to the City Council of the City
of San Diego, and to John Witt, City Attorney of San Diego.

is hereby instructed to add the aforesaid to the Council
Policy i+lanual.
BE IT FURTHER RESOLVED, ti~at'the City Clerk be, and he

policy and map to the cities of Chula Vista, La Mesa and
E1 Cajon.

Two copies of the Montgomery report are transmitted herewith.
It appears that the report adequately covers the question of
system overload, and concludes that the system will be adequate
to take in all presently contemplated service areas.
In answer to the questions concerning overlaps and urban pro-
blems, the San Diego City Council has adopted Policy 400-8
which sets forth certain controls on the admission of new
agencies. Two copies of the Policy are transmitted herewith.
To bring the proposed inclusions uptodate, there have been no
further negotiations with the City of Del Mar nor with the
Otay Municipal Water District. In both cases, ether means may
be selected to solve their sewerage problems. Negotiations
with Pomerado County water District are now in progress, and
you will be kept apprised of the outcome.
A meeting of the Advisory Board should be held in March. At
that time the Aontgomery report and the City Council Policy
can be discussed, along with matters concerning potential
"Later Participating Agencies". ~ time and place for the
meeting will be sent to you in a few weeks.

were approved b}~ the City's electorate on D;ovember 8, 1960.
Part of the security for th•~ bonds are contracts for service,
entered into by si}: adjoining c_.ties and four sanitation
districts. These contracts defined the capacity rights being
reserved and the annual. capital-cost charge for each agency.
Provision ryas made in the. original agre~n;ents for the
participation of other agencies at a later date: viz. .
"The City may contract Frith other cities, districts, public
bodies and agencies of-'_all types. for capacity servi-ce. .
The City Council is given wide latitude in setting the terms
and conditions of such later agreements.
In all cases, the contracts clearly state that "The City shall

The rapid urbanization of San Diec,•o County has created
numerous interrelated problems such as streets and h ighvays,
zoning, flood control, police and fire protection, etc. Only

The term "Sphere of Irifluence" as used in this Policy shall
refer to that portion of San Diego County F;hich is of s_ecific
interest and importance to an incorporated city in carrying
out its respens;biliti.es of planning, zoning, traffic control,
utility serv9_ce, fire and police protection etc.
POLICY

Status of Requests For Inclusion In Nietro System
In April 1970 you. were given notice that the City of San Diego
intended to.enter into agreements with the Otay Municipal 4later
District, the City of Del Mar and the Pomerado County A'ater
District as "Later Participating Agencies". Objections Ore re
filed by three City participants, on the basis that:
(1) The inclusion of new areas could unbalance
or overload the System to the detriment of
present agencies.
(2) New agencies might overlap into territory
already contemplated for service by present
agencies.
(3) Admission of new special. service districts
` could complicate the growth of unplanned
urbanization.
These matters have been given considerable attention by the
City's staff, and the,City Council has taken specific action
to answer the above questions.
A comprehensive study of the Metropolitan Sewerage System has
been made by James M. Montgomery, Consulting, >;ngineers, Inc.
The consultant was directed to analyze the usage data to the
present time and to extend the data to the project's "ultimate
year^, 2003. The consultant also was asked to recommend the
timing of staged expansion items, and to estimate the total
cost of such items.
