HomeMy WebLinkAboutReso 1971-5925 RESOLUTION NO. 5925 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND ALLIED CONTRACTORS, INC., FOR PARTICIPATION IN PUBLIC IMPROVEMENT OF ACACIA AVENUE BETWEEN ITHACA STREET AND OTAY LAKES ROAD The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and ALLIED CONTRACTORS, INC., for participation in the public improvement of Acacia Avenue, between Ithaca Street and Otay Lakes Road, located within Southwestern College Estates Units 5 and 6, dated the 26th day of January , 1971 , a copy of which is attached hereto and incorporated herein, the-8ame as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby authorize the use of 2107 Gas Tax funds, in an amount not to exceed $15,000.00 for the City's proportionate share of the construction costs of said public improvement of Acacia Avenue. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. '~~~ Lane F. AGREEMENT FOR PARTICIPATION IN THE PUBLIC IMPROVE- MENT OF ACACIA AVENUE BEING A MAJOR STREET LOCATED WITHIN SOUTHWESTERN COLLEGE ESTATES UNITS 5 AND 6, CONCURRENT WITH THE INSTALLATION OF PUBLIC IMPROVE- MENTS IN SAID SUBDIVISION THIS AGREEMENT, made and entered into this 26th day of January , 1971, by and between THE CITY OF CHULA VISTA, a municipal corporation, hereinafter called "City", and ALLIED CONTRACTORS, INC., 5109 Waring Road, San Diego, California 92120, hereinafter called "Subdivider" ; WIT N E SSE T H : WHEREAS, Subdivider has or is about to enter into an agreement with the City of Chula Vista providing for the development of public improvements in certain streets located within that certain subdivision to be known as Southwestern College Estates Units 5 and 6, and WHEREAS, one of said streets located within the subdivision is a major street, known as Acacia Avenue, and WHEREAS, Subdivider is required, pursuant to established policy, to pave a 20 foot width right-of-way adjacent to each curb on said street, and City accepts the obligation to pave the 24 foot center strip, and WHEREAS, it is generally accepted that it is desirable to con- struct the City's portion of such major street concurrent with the installation of improvements by the Subdivider, and that, because of the ready availability of construction equipment and elimination of certain work which is caused by stage construction, the work can be performed more economically than if it were to be accomplished separately, and WHEREAS, the following advantages would apply if the City of Chula Vista were to participate in the complete improvement of said major street known as Acacia Avenue rather than subsequently improving said street with a competitive bidding procedure: 1. Subdivider will be performing identical work immediately adjacent to the portion to be paved by City, and consequently will have all necessary equipment and personnel available without additional move-in cost. 2. Subdivider can dispose of excavated material conveniently within the adjacent lots under construction, whereas if the work were accomplished following completion of the subdivision it would be necessary to haul such material to more remote disposal sites, resulting in higher costs. 3. If the total pavement width is constructed as a unit, Sub- divider will not be required to install headers or give other special treatment to the exposed edges of pavement such as would be created with an unpaved island, thus permitting an overall reduction in cost. 4. The integrity, riding quality and aesthetic appearance of a street is superior when all portions are constructed as a single project. 5. Unit prices applicable to large projects are generally lower than those for smaller projects, therefore, in combining the island paving with the paving of the remainder of the subdivision, the Subdivider is in position to perform the work at the lesser rate and to pass some of said saving on to City. -1- ~s ~9q;5- " " - ' I WHEREAS, although a precise structural section has not been determined at this time, and no cost estimate which is reasonably accurate has been developed, it is anticipated that the total cost of the City's participation will be approximately $15,000.00, and WHEREAS, it is agreed that the cost of said center strip will be the same as the unit prices for the subdivision improvement work being performed, plus five percent (5%) of said work for overhead. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. Subdivider agrees to install such improvements, i.e., a 24 foot wide center strip along Acacia Avenue between Ithica Street and Otay Lakes Road, as shown on Drawings No. 70-76D, 70-80D and 70-81D, which improvements include approximately 31,271 square feet of paving. 2. City agrees to pay Subdivider for said improvements, and to participate in the installation of the full public improvement of Acacia Avenue, in an estimated amount of $15,000.00 based upon the following unit costs: Grading..........................$0.37 per cubic yard 3" thick A.C. paving............. 0.128 per square foot 6" thick Class 2 aggregate base.. 0.16 per square foot Class 2 aggregate base........... 0.0223 per inch depth per square foot in excess of 6" depth; in conjunction with the development of Southwestern College Estates Units 5 and 6, plus five percent 5% of the total cost of construction based upon the above unit prices. Said proportionate share of the cost of said improvements will be paid to Subdivider, Allied Contractors, Inc., upon completion and acceptance of said improvements by the City of Chula Vista. 3. City further agrees to make partial payments of the full costs of said participation upon submission and verification of requests for payment, accompanied by paid vouchers, provided, however, that ten percent (10%) of the proposed participation costs shall be held for a period of one (1) month subsequent to the completion and acceptance of said improvements in accordance with the Subdivision Improvement Agree- ment executed by and between Subdivider and City.
