AGREEP~~NT
THIS AGREEMENT is made by and between the Sweetwater
Community College District of San Diego County, California,
hereinafter referred to as "Grantor", and the City of
Chula Vista, County of ran Diego, hereinafter referred
to as "Grantee",
~,11HEREAS, the parties hereto agree that it is to their
mutual interest and benefit to accomplish the extension
of "H" Street in the City of Chula Vista, said extension
which would run across a portion of Grantors property; and
I~JHEREAS, Education Code, Sections 16251 to 16255,
inclusive, authorize the governing board of a school district
to dedicate to a municipal corporation for public street
or highway purposes, either tivith or without consideration
and without a vote of the electors of the district first
being taken, any real property belonging to the district;
NOW THEREFORE
THE PARTIES HERETO MUTUALLY AGREE AS FOLLOWS:
1. Pursuant to the provisions of Education Code,
Sections 16251 to 16255, inclusive, Grantor will take
appropriate steps required to accomplish the dedication
of property for public street or highway purposes to permit
the extension of "H" Street in the City of Chula Vista,

said property being more particularly described ir. the
resolution of intention heretofore adopted by Grantor,
2. After appropriate advertising and posting of
notices and following adoption of the required resolution
ordering the dedication, Grantor will execute the deed of
dedication upon the terms and conditions set forth in this
agreement and in the said resolution of intention,
3, The dedication of the said property will be
without payment or consideration by Grantee.
~-, Subsequent to the said dedication, Grantee will
accomplish the construction of the extension as aforesaid
and will pay or cause to be paid all costs of improvements
and construction of facilities in connection therewith;
provided however, that the off-roadbed improvements whl.ch
front upon the college property remaining at the northwest
corner of intersection of "H" Street and Otay Lakes Road
(including such items as sidewalks, curbs, drains, and
gutters) shall be at the expense of Grantor,
5. At the time of preparation of plans for the extension
of "H" Street as described herein and prior to the comrr~ence-
ment of the work of extension, Grantor will be given appro-
priate opportunity to review the said plans and to indicate
its desires regarding access points to its property on either
or both sides of the said "H" Street extension. Grantee
agrees that every effort will be made to provide such access

points at the places desired by the Grantor and in the event
of disagreernent between the parties, prior to any work being
done to accomplish the extension the matter will be made the
subject of further negotiations between the parties until
an agreement has been reached.
6. Grantee agrees that if within a reasonable period
of time the said property is not needed or used for the
purpose of extending "H" Street as aforesaid, the said
property will revert to Grantor.
7, Grantee agrees to pay all costs and fees :in connection
with the dedication described herein,

On motion of Member MORENO seconded by
Member FRAZER , the following resolution is
adopted:
WHEREAS, this Board on JUNE 17 , 1971,
adopted its resolution of intention to dedicate certain
real property in the City of Chula Vista, County of San
Diego, to the City of Chula Vista for public street or
highway purposes to permit the extension of "H" Street in
the City of Chula Vista, said real property and the details
of the proposed transaction being more particularly described
.in said resolution of intention; and
1n~HEREAS, notice of adoption of said resolution of
intention was properly given in accordance with law; and
WHEREAS, said resolution of intention and notice of
adoption thereof provided that a publ'zc meeting of this
Board would be held at :its regular place of meeting, to wit:

BE IT RESOLVED by the Governing Board of the Sweetwater

the aforementioned resolution of intention to the City of
Chula Vista under the terms and conditions set forth therein.
BE IT FURTHER RESOLVED that the President of this Board
is authorized and directed to execute an agreement with the
City of Chula Vista and subsequent to the execution of said
agreement by both parties thereto to execute a deed dedicating
the interest in real property to the said City of Chula Vista,
in accordance with and incorporating the terms and conditions
set forth in the aforesaid resolution of intention and in
the aforesaid agreement on behalf of the members of this
Board and in the name of the Sweetwater Community College
District, and to deliver the same to the duly authorized
agent of the City of Chula Vista,

drains, and gutters as may be appropriate to the extension
of the said street, all ~•rithout cost to Grantor, except that

section of "H" Street and Otay Lakes Road shall be at

commencement of work in connection therewith, Grantor shall
be given the right to indicate: and express its desires for
appropriate access locations and routes from the said street
to Grantors property on both sides of the said street and

Member BRO1^JNING the following resolution is
adopted:.
~~1HEREAS, the City of Chula Vista, County of San Diego,
State of California, has requested the transfer of land
belonging to the Sweetwater Community College District
for the purpose of extending "H" Street in the City of
Chula Vista; and
WHEREP.S, in the judgment of this Board, public
convenience and necessit~r make it expedient to dedicate
to the laid city land adequate to provide a roadbecz _°or
the said street extension and sufficient additional land
to provide cut and fill slopes for appropriate protection,
and drainage in connection with the said rcadbed; and
WHEREAS, it is the judgment of this Board that the
dedication of the land as a~'oresaid will be of direct
benefit to this district in providing appropriate r,:eans
of approach and access to other property of this district;

publishing the notice concerning this conveyance as

NOTICE IS HEREBY GIVEN that the Governing Board of the
Sweetwater Community College District of San Diego County,
California, on JUNE 17 1971,
adopted a resolution of intention to dedicate to the City
of Chula Vista, County of San Diego, without payment or
other consideration except costs incurred in connection
with transfer of title, certain land in the City of Chula
Vista for the purpose of accowplishing an extension of
"H" Street, said property being in portions of Quarter
Sections 17 and 18, Rancho de la P~acion in the Cour_ty of
San llie~o, according to record of Survey No. 5911 as filed
in the office of the County Recorder of San Diego County
on July 25, 1861.
A legal description of the property proposed to be
dedicated and other particulars of the proposed action
may be examined in the offices of the Sweetwater Cori~^~unity
College District, 500 Otay Lakes Road, Chula Vista,
California .
A public meeting of the Governing Board of the
Sweetwater Community College District will be held at
its reo lar place of meeting, ROOM 801, SOUTHWESTERN COLLEGE,
