Ye.r • DUPLICATE ORIGINAL • AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND EQUESTRIAN TRAILS, TNC. , ESTAB]LISIIING AN EQUESTRIAN TRAIL ON THE SOUTHEF.N BOUNDARY OF TIIE CHULA VISTA MUNICIPAL GOLF COURSE Jux~'HTS AGREEMEI~~, made and entered into this 13th day of 19 , by and between the CITY Or CHULA VISTA, a municipal corporation, hereinafter called "City", and EQUESTRIAN TRAILS, INC., hereinafter referred to as "The Equestrians"; W I T N E S S E T H WHEREAS, City has heretofore entered into discussions with Equestrian Trails, Inc., a riding club operating in the Bonita area, for the purpose of developing an appropriate riding trail along the southern perimeter of the Chula Vista Municipal Golf Course, and WHEREAS, subject to certain rules and regulations, it has been determined that it is possible to establish such a trail in a manner so as not to interfer c~.ith, or create safety hazards for either riders or go]_fers during regular usage of either the trail or the golf course, and WHEREAS, Equestrian Trails, Inc., has indicated its desire to fully cooperate with the City in all aspects of policing such an equestrian trail, and WHEREAS, the City Council has directed that the Director of ParY.s and. Recreation establish such a trail, and that said trail be subject to his supervision and to modification or revocation at any time when, in the opinion of the Director of Parks and Recreation, a need for such action is necessary because of potential hazards to the health and safety of either golfers or riders using the trail. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. That the City shall cause the existing fences at the bridge located at Willow Road at the north and south ends to be closed, except for one opening at each point of entry, and appropriate signs shall be posted at each of said entrance points onto the golf course property. 2. It is mutually understood and agreed that the following general route shall be appropriately marked, signed and delineated, and. the use of said route shall be conducted in the manner set forth herein: (a) Upon entering the golf course property, horses shall head south, hugging the fence line on the west side of the golf course property; (b) Horses will proceed east behind the apartment building, known as La Bonita Apartments, following the existing service road, to be marked with appropriate signs instructing riders to stay on the road and not to ride on the fairways; (c) At the entrance road to the Golf Course Clubhouse, riders shall be instructed to cross and turn immediately to the right and bear to the west of the parking lot until they reach the palm trees that parallel Bonita Road, then east along Bonita Road past the storm drain and onto the service road in front of the golf course maintenance facility, and then continue east to Central Avenue along the existing service road to a point approximately fifty feet north of Central Avenue where an entrance and exit notice shall be posted. -1- ~ /~ 3 . • 3. The following signs shall be posted appropriately by the City, to diz~ect and instruct horse riders utilizing the trail: "NOTICE TO HORSEMEN - Permis granted by the City of Chula any time. Equestrian Trails, Inc., agrees to trim tree branches to open a path up to and behind the third tee, at which point a single file sign shall be posted, and a snow type fence installed by Equestrian Trails. 5. Equestrian Trails, Inc., further agrees that twice a month a trail cleanup party to maintain the trail in a sanitary condition will be scheduled, and at such other intervals as may be deemed necessary by tYie Director of Parks and Recreation. 6. All directional signs and precautionary signs required herein shall be installed by Equestrian Trails, Inc., subject to prior approval of the Director of Parks and Recreation and installed in a manner acceptable to him.
