RESOLUTION NO. 5906
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA GRANTING A SEWER SERVICE CHARGE VARIANCE TO
SEARS, ROEBUCK AND CO., ON THE PROPERTY LOCATED AT
555 FIFTH AVENUE IN THE CITY OF CHULA VISTA
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Sears, Roebuck and Co., a department store located
at 555 Fifth Avenue in the City of Chula Vista, has heretofore applied
for a sewer service charge variance for the water meter serving said
property, and
WHEREAS, the application for said variance for said meter
has been reviewed by the Board comprised of the City Manager, the Director
of Public Works and the Director of Finance of the City of Chula vista,
pursuant to the provisions of Ordinance No. 807 and the Rules of
Interpretation and Procedure for Administration of Requests for Variance
from Sewer Service Charges, and
WHEREAS, said review indicated that approximately two-thirds
of the water delivered to said site is used for cooling or irrigational
purposes and said variance is therefore recommended, based upon the
following conditions:
1. Standard rate sewer charge billing by the California-
American Water Co. shall be discontinued and all future billings shall
be prepared by the City. A service fee of $5.00 per billing shall be
added to each billing to offset the expense of separate handling by the
City.
2. The quantity of water subject to sewer service charge
shall be the total delivered less the quantity lost to evaporation in
the cooling tower and the amount used in the automatic sprinkler system.
Evaporative loss in the cooling tower shall be determined from bi-
monthly readings, and the variance charge shall be computed in accordance
with the formula set forth in the recommendation attached hereto and
made a part hereof.
3. The variance shall be considered retroactive to the time
of installation of the cooling tower meter (October 2, 1970) and over-
payment of sewer service charges subsequent to said date shall be
credited against the amounts due under the sewer service billings
until the total overpayment is offset.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the'
City of Chula Vista that based upon the above findings and conditions,
a variance shall be granted on said meter, with all subsequent charges
to be computed by the City of Chula Vista.
BE IT FURTHER RESOLVED ,that the City Clerk of the City of
Chula Vista be, and she is hereby authorized and directed to forward
a certified copy of this resolution to' the California-American Water
Co., and to Sears, Roebuck and Co., 555 Fifth Avenue, Chula Vista,
California.

FROM:
SUBJECT: Sewer Service Charge - Sears Variance
The City Council has requested submission of additional
data regarding costs associated with the above referenced
action.
Large quantities of water are used at this site for purposes
which do not impose a load upon the sewer system. Water
used for irrigation is estimated to total 165,000 gallons
bi-monthly.
The other major use which does not enter the sewer is for
cooling purposes. In order to determine the exact amount
so used, Sears has installed a meter upon the feed-Y7ater
line. However, this installation is very recent and so we
have limited information concerning this particular use.
It is logical to assume that the evaporation rate will be
higher during summer months than during the remainder of
the year.
During the 54 day period of metered flow there was an
average consumption of 6,444 gallons per day.
It is not possible to make a precise .determination of the.
difference in sewer service charge, We can at best make
an estimate BASED UPON VERY LIMITED INFORMATION. . The
following is based upon six recent bi-monthly billings:
l. Total gallons delivered 5,790,500 gal.
2. Total water cost $2,650.20
3. Total sewer service charge $742.05
4. Estimated usage which did not
enter sewer 3,306,000 gal.
5.. Net quantity subject to sewer
service charge 2,484,500 gal.
6. Proportionate cost for (5) $1,137.10
7. Sewer service charge which would
have been collected under terms
of proposed variance .$318.39
, . ~ . I ~,. ..
~[S. :5qolo
-2-
Thus, during the specified period the total billing for
. sewer service charge would have.been reduced. by $423.66,
or approximately 57%. It would appear that the typical
amount paid by Seaxi, Roebuck and Company will be reduced
by approximately on~~:;'half. However, the above, calculations
are based upon very limited information concerning water
usage in the cooling system; and therefore must be regarded
as a rough approximation only. .
