SUMMARY
On December 14, 2011, the Director of Public Works received eleven (11) sealed bids for the
"Sidewalk Replacement FY2011-2012 at Various Locations (JY065R)" Project. The project was
included in the annual Public Works Street Maintenance budget to 7emove and replace curbs,
gutters, sidewalks, and driveways displaced by street trees on various City streets as listed in
Attachment 1. The proposed resolution, if approved, would award the contract for this project to
the low bidder in the amount of $59,348.10 and authorize the expenditure of all available
contingency funds not to exceed $25,651.90.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed project for compliance with the
California Environmental Quality Act (CEQA) and has determined that the project qualifies for a
Class 1(c) categorical exemption pursuant to Section 15301 [Existing Facilities] of the State
CEQA Guidelines because the capital improvement project consists of removal and replacement
of existing curbs, gutters, sidewalks, asphalt/concrete pavement and driveways displaced due to
the overgrowth of tree roots. All proposed repair work to be done within existing street right-of-
way. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
This annual Public Works Street Maintenance sidewalk replacement project is funded in the
fiscal year 2011-2012 budget. Project design staff prepared specifications and location plats and
advertised the project on November 18, 2011.
On December 14, 2011, the Director of Public Works received eleven (11) bids as follows:

The low bid submitted by Carolino Construction Corporation is below the Engineer's estimate of
$85,000 by $25,652 (approximately 30% below the Engineer's estimate). Staff conducted a
detailed check of references provided by the contractor and determined that the contractor has
performed their work satisfactorily. Staff has reviewed the contractor's bid package and
recommends awarding the contract to Carolino Construction Corporation in the amount of
$59,348.10. Carolino Construction Corporation is a licensed General Engineering Contractor,
General Building Contractor, Lathing and Plastering Contractor, and Construction Zone Traffic
Control Contractor and their License No. 831710 is current and active.
The proposed resolution would also authorize the Director of Public Works to approve change
orders over and above existing policy limits. Under City Council Policy No. 574-01, if an
individual change order causes the cumulative increase in change orders to exceed the Director's
authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is
required. The corresponding maximum aggregate contract increase that may be approved by the
Director of Public Works under Policy No. 574-01 is $5,934. Approval of tonight's resolution
would increase the Director of Public Works' authority to approve change orders, as necessary,

up to the contingency amount of $25,651.90, an increase of $19,717.10 over Policy No. 574-01.
Increasing the contingency funds will allow staff to continue the project without delay should
unforeseen circumstances resulting in increased project costs arise during the course of
construction, as well as make adjustments to bid item quantities. Unforeseen conditions include
such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the
contingency funds are not used, then they will be returned to the project fund balance. Further,
because the contractor's bid is significantly lower than the Engineer's estimate, most, if not all,
of the supplemental locations listed in Attachment 1 will be completed using contingency funds.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that the decision
concerns for repairs, replacement, or maintenance of existing streets or similar facilities and,
therefore, there is not a material financial effect of the decision on the property holdings of the
City Council Members pursuant to California Code of Regulations sections 187042(b)(2) and
18705.2(b)(1).
CURRENT YEAR FISCAL IMPACT

TOTAL FUNDS REQUIRED FOR CONSTRUCTION $85,000.00
Sufficient funds are budgeted for staff costs for design and inspections, estimated at $20,000 in
the Public Works Operating budget. The contract amount of $59,348.10 plus the contingencies
and remaining funds in the project results in a total construction cost of $85,000, which is
budgeted in the Street Maintenance budget.
ONGOING FISCAL IMPACT
Upon completion of the project and one-year contractor maintenance period, the improvements
will require only routine normal maintenance of the street facilities and stormwater best
management practices.

WHEREAS, the low bid by Carolino Construction Corporation Inc. of $59,348.10 is
$25,652 (approximately 30%) below the Engineer's estimate of $85,000; and
WHEREAS, staff has reviewed the low bid and determined the bid package is complete
with no errors or omissions; and
WHEREAS, staff has verified the references provided by the Contractor and determined
them to be satisfactory; and
WHEREAS, in order to approve change orders as necessary, staff is requesting City
Council waive Council Policy No. 574-01; and

WHEREAS, the contract amount of $59,348.10 plus the contingencies and remaining
funds in the project results in a total construction cost of $85,000, which is budgeted in the Street
Maintenance budget; and
WHEREAS, sufficient funds are budgeted for staff costs for design and inspections,
estimated at $20,000 in the Department of Public Works operating budget.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids and awazds the contract for the "Sidewalk Replacement FY2011-
2012 at Various Locations (JY065R)" Project to Carolino Construction Corporation, Inc. in the
amount of $59,348.10.
BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does
hereby waive Council Policy No. 574-01 and authorize the Director of Public Works to expend
all available contingency funds in an amount not to exceed $25,651.90.
