HomeMy WebLinkAboutReso 1971-6294RESOLUTION NO. 6294 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA URGING THE LEGISLATURE TO AMEND SECTION 11525.2 OF THE BUSINESS AND PROFESSIONS CODE OF THE STATE OF CALIFORNIA REQUIRING DEDICATION OF LAND FOR SCHOOLS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has heretofore heard representatives of the Sweetwater Union High School and the Chula Vista City School District concerning the difficulties of working with the State Legislation requiring the dedication of school sites because of unreasonable restrictions and requirements therein, and WHEREAS, the City Council of the City of Chula Vista concurs with the school districts that said legislation should be appropriately modified to provide a more reasonable program for the acquisition of school sites. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby urge the Legislature to amend Section 11525.2 of the Business and Profession Code of the State of California, by eliminating the provision requiring 400 dwelling units within a single school district and substituting therefor a provision which would allow for the reservation of all or a portion of required school sit es as shown on an adopted General Plan for school sit. es within any subdivision regardless of the size thereof. BE IT FURTHER RESOLVED that the termination of the re- quirements of dedication presently enforced within thirty (30) days after the requirement is imposed be changed so as to allow a period of ninety (90) days and, further, that the provision relative to imposition of the requirement prior to the construc- tion of the 4.Olst dwelling unit be eliminated. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista urges all members of the San Diego County Legisla- tive delegation to support such legislation and also such legis- lation as will provide for more realistic financing from the State of California for the acquisition and development of school sites and eliminate the reliance on local property taxes for schools. BE IT FURTHER KESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized authorized and directed to forward a certified copy of this resolution to all members of the San Diego County Legislative delegation.
