RESOLUTION OF THE CITY COUPICIL OF THE CITY OF CHULA
VISTA DECLARING ITS INTENTION TO ESTABLISH A PARKING
AND BUSINESS IMPROVEMENT AREA, TO PROVIDE FOR THE LEVY
OF AN ADDITIONAL BUSINESS LICENSE TAX ON SPECIFIED
BUSINESS CONDUCTED WITHIN SUCH AREA, CLASSIFYING
VARIOUS BUSINESS FOR SUCH PURPOSE, DESCRIBING THE
BOUNDARIES OF THE PROPOSED AREA, THE PROPOSED USES
TO WHICH THE ADDITIONAL REVENUE SHALL BE PUT, THE
INITIAL RATE OF INCREASE FOR ADDITIONAL LEVY OF THE
LICENSE TAX, FIXING THE TIME AND PLACE FOR A HEARING
TO BE HELD BY THE CITY COUNCIL TO CONSIDER THE ESTAB-
LISHMENT OF SUCH AN AREA, AND DIRECTING THE GIVING OF
NOTICE OF SUCH HEARING
The City Council of the City of Chula Vista does hereby
resolve as follows:
1. Authority. The proceedings herein taken are taken pur-
suant to the authority of the "Parking and Business Improvement Area
Law of 1965", being Section 36000 et seq, of the Streets and Highways
Code.
2. Intention. The City Council hereby declares its inten-
tion to form a Business Improvement Area in the City of Chula Vista in
accordance with the provisions of said law.
3. Name. The name of the proposed parking and business
improvement area intended to be formed is "DOWNTOWN BUSINESS IMPROVE-
MENT AREA OF THE CITY OF CHULA VISTA".
4. Description. The description of the boundaries of the
proposed improvement area are as set forth in Exhibit "A" attached
hereto and by reference made a part hereof, but generally bounded by
certain properties on the north side of "E" Street and the north side
of Alvarado Street to the south, the center line of Landis Avenue west
of Third Avenue with the exception of those properties located in the
area between Center Street and Park Way extending to Fourth Avenue on
the west and by Church Avenue on the east as more specifically shown
in Exhibit "B", attached hereto.
5. Proposed Uses. The proposed uses to which the proceeds
from the additional tax revenue realized from the additional levy of
license tax as hereinafter provided shall be put are:
a. Decoration of any public place in the improvement
area.
b. Promotion of public events which are to take place
on or in public places in the improvement area.
c. Furnishing of music in any public place in the
improvement area.
d. The general promotion of retail trade activities
in the improvement area.
6. Additional Levy of License Tax. It is proposed that the
initial rate of increase or additional levy of business license tax on
businesses conducting their activities in the proposed improvement area,
which is an addition to the ordinary business license tax imposed on
such businesses by Article II of Chapter 18 of the Chula Vista City
Code in accordance with the class of business being conducted, shall
be as set forth in Exhibit "C" attached hereto and incorporated herein
by reference.

7.' Definitions and Classifications. The definYti~ons~and
classifications of businesses, as hereinabove set forth, shall be
determined by the definitions and classifications as set forth in
Chapter 18 of the Chula Vista City Code.
8. Collection of Additional Taxes. The collection of the
additional levy to the license tax proposed by virtue of this pro-
ceeding shall be made at the same time and in the same manner as the
ordinary business license tax of the City under the provisions of
Chapter 18 of the Chula Vista City Code, and such tax proposed to be
imposed under this proceeding shall be computed in the manner provided
in said Chapter 18 for each business, but according to the schedule
contained in Exhibit "C" attached hereto, and shall be due and payable
as provided in said Chapter 18 of said Code.
9. Exemptions: Voluntary Contribution. Any business, person
or institution which is exempt from the payment of the ordinary business
license tax of the City by reason of the provisions of the United States
or State Constitutions, regardless of the location of said business, may
make a voluntary contribution to the improvement district. Such contri-
bution shall be used for the purposes provided in this resolution.
10. Multiple Licenses at Same Business Location - Single
Assessment Only• If more than one business is being conducted at a single
ad ress and more than one business license has been issued to the proprietor
of a single business premise, the assessment for the business improvement
district shall be levied as an additional charge against that license for
which the highest fee is paid.
11. Advisory Committee. An eleven-man Advisory Committee shall
be established to manage and direct the affairs of the improvement district.
The terms of the members of said Advisory Committee shall be for a period
of three (3) years, which term shall be staggered initially by drawing
lots so that three (3) members shall serve for one (1) year, four (4)
members shall serve for two (2) years and four (4) members shall serve
for three (3) years. The members of said Advisory Committee shall be
selected from the memberships of the Board of Directors of the Downtown
Association (proposed to be renamed Beautiful Downtown Chula Vista, Inc.)
and the Downtown Improvement District Steering Committee. Membership of
said body shall consist of persons who have businesses or are agents of
business owners within the proposed improvement area and who either pay
the additional levy of tax as provided for herein, or make voluntary
contributions as provided fo~ herein.

12. Time and Place of Hearing; Notice. Notice is hereby
given that Tuesday, the l~Ch day of October, 1971, at the hour of
7:00 p.m., in the Council Chambers of the City Hall, 276 Fourth Avenue,
in the City of Chula Vista is the time and place fixed for the hearing
on this resolution of intention for the proposed formation and estab-
lishment of said improvement area, the extent thereof, the boundaries
thereof, the proposed amount of additional levy of license tax, the
classification of businesses, or to any other proposal or matter set
forth in this resolution of intention, may appear before the Council
at said time and place above specified and be heard.
13. Publication and Mailing of Notice. The City Clerk shall
cause this resolution to be published at least once in the Chula Vista
Star News, a newspaper of general circulation printed and published in
said City, the first publication to be at least ten (10) days prior to
the date of said hearing. The City Clerk shall also mail a copy of
this resolution to each business in the proposed business improvement
area, as described herein, which mailing shall be completed at least
ten (10) days prior to the date of said hearing, all in accordance
with Section 36022 of the Streets and Highways Code of the State of
California.
