HomeMy WebLinkAboutReso 1972-6373RESOLUTION NO. 6373 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA URGING THE AMENDMENT OF SECTION 131 (g) OF TITLE I OF THE HIGHWAY BEAUTIFICATION ACT AND A DELAY IPd THE IMPLEMENTATION OF SAID PROVISIONS UNTIL A MORE THOROUGH STUDY CAN BE UNDERTAKEN The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the California Roadside Council has long opposed the provisions of Section 131 (g) of Title I of the Highway Beauti- fication Act, which provides for compensation to be paid for the elimination of billboards along interstate highways, and WHEREAS, the California Roadside Council indicates their belief that the implemenation of this act, which would provide for compensation for removal of billboards adjacent to freeways with federal funds, would be disastrous to the program of billboard control and prohibition utilizing the amortization approach, and WHEREAS, because of a failure to adhere to federal standards, the State of California would possibly lose 10$ of federal highway funds which would seriously cripple the freeway program in the State of California, and WHEREAS, the amortisation approach might be precluded from application to those billboards qualifying under the federal law for compensation upon their removal; it would be ironical indeed if the billboard industry were to begin to argue that all of their billboards were indeed intended primarily to be viewed from the freeways, which is contrary o their present position whenever the state law has been applied to any one of their billboards, and WHEREAS, we in the City of Chula Vista would become involved in a dual program of enforcement which would greatly complicate the entire schedule of billboard removal, i.e., billboards on the freeway would be subject to removal if compensation is paid, billboards in the balance of the community would be subject to removal upon com- pletion of amortization schedules, and WHEREAS, the whole matter of regulation or prohibition of billboards would be reopened in the courts with unfortunate results for all of the cities attempting to prohibit billboards in terms of delay. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Chula Vista joins the California Roadside Council in urging the amendment of Section 131 (g) to permit each state upon meeting federal standards either by payment of compensation or by amortization to be under the state's police power. BE IT FURTHER RESOLVED that the Secretary of the Department of Transportation, the Honorable John Volpe, should seriously review this portion of the Highway Beautification Act in terms of its effect upon the several cities and their programs of billboard regulation and prohibition, and some arrangement be made which would strengthen the cities' regulatory process rather than creating the support of problems outlined hereinabove. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward certified copies of this resolution to the Secretary of the Department of Transportation, the Honorable John Volpe, and to Senators Cranston and Tunney and Congressmen Van Deerlin and Wilson.
