HomeMy WebLinkAboutReso 1972-6367RESOLUTION NO. 6367 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DIRECTING THE CITY CLERK TO COLLECT APPROPRIATE FEES FROM NECESSITATED PARTIES PURSUANT TO THE SCHEDULE OF FEES SET FORTH IN SECTION 54900 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA TO BE PAID TO THE STATE BOARD OF EQUALIZATION The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Section 54902.5 of the Government Code of the State of California directs the State Board of Equalization to establish a schedule of fees for filing and processing the state- ments, maps or plats which are required to be filed with the State Board of Equalization in conjunction with such changes in boundaries affected by annexation or re-organization or establishment of dis- tricts, and WHEREAS, the schedule shall not exceed the reasonably anticipated cost to the State Board of Equalization of performing the work to which the fee relates, and WHEREAS, said fee schedule has been established to be effective March 4, 1972, and WHEREAS , the State Board of WHEREAS , action which ultim~ deemed appropriate said fees. the City is obligated to make such payments to Equalization, and in those cases where citizens have initiated the ~tely requires the payment of said fees, it is for the City to be reimbursed for the amount of NOW, THERFORE, BE IT RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to collect fees in the amount of the schedule set forth in Section 54900 et seq, of the Government Code, in those cases where the activity requiring and relating to the particular fees was initiated by the individual. BE IT FURTHER RESOLVED that any parties who are requested to make payments of said fees shall have the right to appeal said decision of the City Clerk to the City Council and ask that said fees be waived based upon a showing of good and reasonable cause for said waiver. BE IT FURTHER RESOLVED any such fees collected shall be placed in a separate account by the Director of Finance to be held in trust solely and exclusively for the payment of said fees to the Board of Equalization in accordance with the directions of the Board of Equalization. Exec ufive Secretary This letter is addressed 'to everyone responsible for making filings with the Board of Equalization and the county assessors pursuant to Sections 54900-54903 of the Government Code. `~/~Ztvu~z, Effective ~-~rtrary-~; 1972, AB-16'75 passed by the 19'71 Legislatures requires all costs for preparing, maintain- ing and supplying tax area maps be borne by those who benefit from the services. For your conven~.ence, the new law (C:~apter 1137, Statutes of 19'71) is printed on the reverse side of this letter. To comply with this new statute the State Board of Equalization has adopted the attached schedule of filing and processing fees. This schedule will be reviewed annually to raflect the program costs for the fiscal year. This schedule was designed to cover the variety of statements filed pursuant to Sections 54900-54903 of the Government Code. If you have a situation that is not specifi- cally covered by the schedule, use the closest category. The acreage involved should be computed to the nearest full acre. The acreage increment may be disregarded if the area comprises less than one acre. If you have made more than 25 filings per year in past years, quarterly payments of fees will be considered. If you meet this requirement and wish to make arrangements for quarterly payments, or have any questions concerning the schedules please write or telephone the Valuation Division of the State Board of Equalization. EASTMAN, Chief VALUATION DIVISION 1~~ t`i~ ~ ~~/ t STATE BOARD OF EQUALIZATION SCHEDULE OF FEES FOR PROCESSING STATEMENTS AND MAPS FILED PURSUANT TO SECTION 54900, ET SEQ., OF THE GOVERNMENT CODE Effective Jonuary 1, 1972 Fees are to accompany statements filed pursuant to Section 54900 et seq of the Government Code unless prior arrangement for periodic payment has been made. 1. City incorporations, district formations or addition of existing districts to tax rolls; Reorganizations including the formation of districts or incorporation of cities. $100 + $0.50 per acre (1)(2) 2. Annexations to or detachments from districts $30+ $0.50 per acre (1)(2) 3. Annexations to or detachments from cities $40+ $0.50 per acre (1)(2) 4. Creation of temporary zones within highway lighting districts $10 per zone in addition to annexation fee 5. Creation of zones or improvement districts concurrently with formation of "Parent" district $25 per zone or improvement district (1)(2) 6. Creation of zone or improvement district subsequent to formation of "Parent" district $50 + $0.50 per acre (1)(2) 7. Reorganizations not including formation of districts or incorporation of cities $40+ $0.50 per acre (1)(2) 8. Name changes or formation of districts or zones that are coterminous with existing cities or districts; Dissolutions $20 per county (1) No fee shall exceed $350 except when the action covered by the statement involves more than one county. In such cases, add $50 for the second or each subsequent county. (2) If the action covered by the statement involves two or more noncontiguous areas, add $10 per area to fee.
