RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA FINDING THAT CERTAIN PARK DEVELOPMENT WORK AT
SEVERAL PARKS IN THE CITY OF CHULA VISTA BE, AND THE
SAME IS HEREBY EXCEPTED FROM THE REQUIREMENTS OF
SECTION 1109 OF THE CHARTER OF THE CITY OF CHULA
VISTA AND THAT COMPETITIVE BIDDING FOR THE ACQUISITION
OF MATERIALS AND EQUIPMENT AND SERVICES FOR THE COM-
PLETION OF SUCH PROJECTS IS IMPRACTICAL AND THAT SAID
WORK MAY BE PERFORMED MORE ECONOMICALLY BY CITY WORK
FORCES
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the sum of $100,000 is budgeted for park develop-
ment including landscaping, irrigation and other physical park im-
provements for Loma Verde Park, Palomar Park, Hilltop Telegraph
Canyon Park and turfing of playground areas at three elementary
schools in the City of Chula Vista, and
WHEREAS, the development plans for some of these projects
have been prepared by the City's Landscape Planner who will be re-
sponsible for much of the detail work on said projects, and
WHEREAS, the major grading, installation of concrete walks
and street paving will be accomplished by competitive bidding, and
WHEREAS, the unique timing and coordination demands of
these projects require direct supervision of the City's Landscape
Planner and complete flexibility in the utilization of the planner,
Director of Parks and Recreation, and supervisory Parks and Recrea-
tion field personnel, and
WHEREAS, the Landscape Planner will be the designer and
immediate supervisor of the projects to be able to handle problems
which may arise requiring immediate action in terms of changes so
that to be encumbered by an independent contractor in instituting
such changes would result in significant cost and coordination
problems, and
WHEREAS, there is also a need compounding the problems of
said working relationship to coordinate the efforts of the Public
Works Department and the Building and Housing Inspection Department,
and
WHEREAS, said construction projects can be partially
accomplished by use of existing City work forces during slack
workload periods as these may occur and the coordination of the
use of said work forces requires the direct City control for the
entire project rather than the use of a prime contractor, and
WHEREAS, it should also be noted that PEP personnel will
also be utilized to augment the construction work and coordination
through an independent contractor would be most difficult perhaps
creating problems with the unions, and

WHEREAS, the City Manager having reviewed the recommendations
of the several department heads and the projects to be accomplished
in accordance with said recommendations has heretofore recommended to
the City Council in accordance with Section 1109 of the City Charter,
that said work can be performed better and more economically by the
CIty with its own employees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that based upon the facts set forth hereinabove
and the recommendation of the City Manager of the City of Chula
Vista that the requirements in Section 1109 of the City Charter be,
and the same are hereby waived and those projects set forth in the
1971-72 Capital Improvement Program under priority project lA as
indicated hereinabove, be accomplished by the appropriate City
forces and that competitive bidding requirements be waived for the
acquisition of necessary materials and equipment which may be pur-
chased in the open market.
BE IT FURTHER RESOLVED that said resolution may be
adopted by the affirmative vote of at least four members of the
City Council of the City of Chula Vista.
