RESOLUTION OF THE CITY COLINCIL OF THE CITY OF C13ULA
VISTA ESTABLISF~ING A POLICY FOR CONSIL'ERATION OF
REQUESTS FOR FUNDING BY PRIVATE ORGANIZATIONS OR
INDIVIDUALS
The City Council of the City of Chula Vista does hereby
r~>~olve as follows:
WE-IEREAS, the City Council of the City of Chula Vista is
from time to time requested to lend financial assistance to private
organizations or individuals in carrying out programs or activities
deemed. to be beneficial to the interests of the citizens o.f_ the
community of Chula Vista and therefore constituting a municipal
purpose allowing the expenditure of public funds therefor, and
WHEREAS, the City Council desires to promulgate a policy
to assist the Council and private organizations or individuals in
considering requests for said funding.
NOTrJ, THEREFORE, BE IT P,ESOLVED that the City Council of
the City of Chula Vista. does hereby adopt the following policy:
1. The City will only fund a legally constituted
non-profit corporation completely directing, and in
complete control of., its own affairs through its own
officers or members. The .f.unctions or services to
be perfcrmed must be of. a nature that the interests
of the City are better served by an agreement arrange-
ment with a private organization than by per.f_ormance
of the services or functions by the City.
2. Financial support of individuals shall not be
approved unless they are citizens of Chula Vista
and the purpose o_f or reason. .f_or support serves a
specific, tangible benefit to the City of Chula
Vista.
3. All organizations or individuals must, prior tc
submitting a request. for funding by the City Council,
submit in writing to the City Clerk a. declaration
signed by a responsible officer of the organization
or by the individual making the request that said
organization or individual does not engage in any
discriminatory practices either de jure or de facto
and that they fully support the national policy of
racial and ethnic equality.
4. Requests for funding by private organizations/
individuals shall be submitted on cr before the last
Monday in the month of February of each year and must
be accompanied by: A detailed operatincr buc7.get showinq_
the source of revenues f_or operations and th.e nature
of all proposed expenditures by object; an audited
financial statement covering the organizations' last
complete fiscal year relating actual revenues and
expenditures to the budget estimates for that year and
indicating any operating surplus or deficit; and a
statement outlining the proposed program of_ the organ-
ization for the year for which support is being requested.

5. All requests f_or support by private organizations/
individuals will be referred to the City Manager for
his analysis and recommendation. The City Manager
will review requests in the light of the contribution
to the service rendered by the organization/individual
towards the achievement of community goals.
F. No expenditure may be made out of any appropriation
until a written agreement setting out the terms and
obligations of the parties has been consumated. The
agreement will specify in detail the services or func-
tions to be performed, the nature of the reimbursement
schedule and financial reporting requirements.
7. All agreements will provide that any organization/
individual receiving financial support .f..rom the City
agrees that the City will be permitted to inspect all
books and records of the private organization/individual
and to perform audits the City reasonably desires.
8. All agreements will provide that the organization
will obtain,. unless exempted by the Director of Finance,
an audit by a Certified Public Accountant upon the
resignation, retirement or discharge of its executive
director or other m.anaginq agent or a majority change
in the membersYiip of the Loard of Directors, and that
a copy o.f that audit shall be filed with the City before
any further City funds are released to the organization.
9. P.11 agreements will provide for the City_ tc with-
hold funds from the organization/individual and to
terminate its entire obligation upon rioti.ce to the
organization/individual if the organization/individual
violates any of the terms of the agreement or for other
good cause shown not related to a violation of. the terms
of_ the agreement. The City Manager shall thereafter
notify the City Council of. the notification of termi-
nation made to the orcranization/individual.
10. All present agreements which do not conform to the
provisions of this policy shall be revised to so conform
as soon. as legally possible after the adoption of this
policy.
