RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING THAT CERTAIN MEMORANDUM OF UNDERSTANDING
CONCERNING THE TERMS AND CONDITIONS OF A STAND-IN
POLICY BETWEEN THE CITY OF CHULA VISTA AND THE CHULA
VISTA FIREFIGHTERS' ASSOCIATION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Management Negotiation Team representing the
City Manager of the City of Chula Vista, acting for and on behalf of
the City Council of the City of Chula Vista, have heretofore met and
conferred with the Chula Vista Firefighters' Association, an organi-
zation representing certain members of classified employees in the
Fire Department, in accordance with the provisions of Section 3500
et seq. of the Government Code of the State of California, and
WHEREAS, the Memorandum of Understanding jointly prepared
by said parties as a result of meeting and conferring has been pre-
sented to the City Council and is contained in Exhibit "A", attached
hereto and incorporated herein by reference as if set forth in full.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby approve and accept said Memorandum
of Understanding as contained in Exhibit "A".

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY
OF CHULA VISTA AND THE CHULA VISTA FIREFIGHTERS'
ASSOCIATION CONCERNING THE TERMS AND CONDITIONS
OF A STAND-IN POLICY
WHEREAS, the representatives of the City Manager of the City of Chula Vista,
acting for and on behalf of the City Council of the City of Chula Vista, have
heretofore met and conferred with the Chula Vista Firefighters' Association,
an organization representing certain members of classified employees in the
City of Chula Vista, in accordance with the provisions of Section 3500 et seq.
of the Government Code of the State of California.
WHEREAS, as a result of meeting and conferring in good faith with said group,
agreement has been reached on the following terms and conditions of a Stand-In
Policy as applied to those classified employees who are members of and repre-
sented by the Chula Vista Firefighters' Association, and said representatives
of the City Manager and of the Chula Vista Firefighters' Association do now
jointly prepare a written Memorandum of Understanding concerning said agreed
terms and conditions of employment for presentation to the City Council of
the City of Chula Vista for determination, to-wit:
1. City hereby agrees to the adoption of a Stand-In Policy which allows
one firefighter to stand-in for another during the normal twenty-four
(24) hour workday under the following provisions:
a. Stand-ins shall only be rank for rank.
b. Pay for stand-in shall be on a straight-time basis.
c. Stand-ins shall be at the discretion of the Shift Commander
with no predetermined limitations.
d. Floating Holiday time shall be used, if available, before a
stand-in is approved.
e. If stand-in time is not paid back in kind during the same pay
period, it shall be reflected on the payroll as time off
without pay.
f. Early reliefs shall be subject to these same procedures.
2. It is further understood and agreed that any other benefits and working
conditions and the terms and conditions thereof presently in effect shall
remain unchanged (except for amendments to the Civil Service Rules which
liberalize employee benefits) unless and until said terms and conditions
shall be modified as a result of meeting and conferring in good faith
between the City and the Chula Vista Firefighters' Association pursuant
to the provisions of Section 3500 of the Government Code of the State
of California.

3. It is further understood and agreed that if and in the event that the
Legislature of the State of California adopts legislation which becomes
law related to and affecting any of the terms and conditions of the
Stand-In Policy agreed to in this Memorandum of Understanding, that
this Memorandum shall be void and of no further force and effect and
all terms and conditions herein shall be subject to renegotiation.
