HomeMy WebLinkAboutReso 1972-6490RESOLUTION NO. 6490 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THAT CERTAIN MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA EMPLOYEES' ASSOCIATION FOR FISCAL YEAR 1972-73 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Management Negotiation Team representing the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with the Chula Vista Employees' Association, an organization representing certain members of classified employees in the City of Chula Vista, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California, and WHEREAS, the Memorandum of Understanding jointly prepared by said parties as a result of meeting and conferring has been pre- sented to the City Council and is contained in Exhibit "A", attached hereto and incorporated herein by reference as if set forth in full. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve and accept said Memorandum of Understanding as contained in Exhibit "A" for fiscal year 1972-73. DATED City Clerk MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA EMPLOYEES' ASSOCIATION FOR FISCAL YEAR 1972-73 WHEREAS, the representatives of the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with the Chula Vista Employees' Association affiliated with the San Diego County Employees' Association, an organization representing certain members of classified employees in the City of Chula Vista, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California. WHEREAS, as a result of meeting and conferring in good faith with said group, agreement has been reached on the following terms and conditions of employment as applied to those classified employees who are members of and represented by the Chula Vista Employees' Association, and said representatives of the City Manager and of the Chula Vista Employees' Association do now jointly prepare a written Memorandum of Understanding concerning said agreed terms and conditions of employment for presentation to the City Council of the City of Chula Vista for determination, to-wit: 1. City hereby agrees to that certain salary understanding for Fiscal Year 1972-73 as contained in Attachment "A" attached hereto and incorporated herein by reference as it sets forth in full. 2. City hereby agrees to the following benefit proposals and changes in the Civil Service Rules as required: a. Adoption of the Sick Leave Reimbursement Plan contained in Attachment "B" attached hereto and incorporated herein by reference as it sets forth in full. b. Management will review the City's policy regarding injury leave. 3. It is further understood and agreed that any other benefits and working conditions and the terms and conditions thereof presently in effect shall remain unchanged (except for amendments to the Civil Service Rules which liberalize employee benefits) unless and until said terms and conditions shall be modified as a result of meeting and conferring in good faith between the City and the Chula Vista Employees' Association pursuant to the provisions of Section 3500 of the Government Code of the State of California, provided, further, however, that all terms and conditions agreed upon by this Memorandum of Understanding shall remain in full force and effect for the entire fiscal year 1972-73. It is further understood and agreed that if and in the event that the Legislature of the State of California adopts legislation which becomes law at any time during the fiscal year 1972-73 related to and affecting any of the terms and conditions of employment agreed to in this Memorandum of Understanding, that this Memorandum shall be void and of no further force and effect and all terms and conditions herein shall be subject to renegotiation. ~~~ v John R. Sick leave will continue to be earned and accumulated at the rate of 12 days per fiscal year. 2. For employees using 4 days of sick leave, or less, during the fiscal year, the option of converting 25% of their remaining yearly sick leave to pay is offered. This is not mandatory and all unused sick leave may be carried over if the employee desires. 3. Pay will be computed using the following schedule: Remaining, Sick Leave 12 days 11 days 10 days 9 days 8 days 7 or less Pay (Option) 3 days 2 days, 6 hrs. 2 days, 4 hrs. 2 days, 2 hrs. 2 days 0 All computations will be rounded to the nearest whole hour. (Example: 11 days, 5 hours remaining sick leave = 93 hours x .25 = 23.25 hrs. = 23 hours of pay). 4. If the pay option is selected the paid sick leave hours will be sub- tracted from the employees accumulated yearly sick leave balance. The remaining sick leave hours may be accumulated indefinitely. (Example: Employee uses 4 days sick leave. He then elects to receive pay for 25% of remaining days or 2 days. The 2 days are subtracted from his sick leave and the other 6 days are added to the employees accumulated sick leave balance). 5. This sick leave reimbursement plan will commence July 1, 1972. Payment will be made during the month of July of each succeeding year. 6. Pay will be computed based on the employees salary step on June 30. 7. Payment will be made to an employee hired during the fiscal year provided he is on the payroll June 30. Permanent employees who retire during the fiscal year will be compensated under this plan based on their formal retirement date. Payment will not be made to an employee who terminates during the fiscal year. However, in the event of the death of an indi- vidual while employed by the City, 50% of the employee's unused accumulated sick leave will be paid to his beneficiary. .~ __'~ L
