HomeMy WebLinkAboutReso 1972-6471RESOLUTION NO. 6471 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE RELEASE OF THAT CERTAIN DEFERRED IMPROVEMENT AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND HAROLD M. AND RITA T. BENHARDT, RECORDED MARCH 13, 1972, AS FILE NO. 59817 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Harold M. and Rita R. Benhardt have heretofore entered into an agreement with the City of Chula Vista providing for the installation of certain improvements on their property, in the amount of $2,000.00, and WHEREAS, said agreement provided for the imposition of a lien upon the property owned by the Benhardts, and WHEREAS, the Benhardts now desire to refinance the property, and WHEREAS, in order to do so, it will be necessary to obtain a release of the lien, and WHEREAS, it is agreed that in place of the lien, a deposit of $2,000.00 will be pledged to the City of Chula Vista to be used solely and exclusively for the purposes outlined herein, and said deposit will be made, concurrently with the release of the lien, in the San Diego Federal Savings and Loan Association. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that based upon the representations of the San Diego Federal Savings and Loan Association, that said improve- ment agreement be, and the same is hereby authorized for release. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute the release attached hereto and incorporated herein by reference as if set forth in full. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward a certified copy of this resolution to the San Diego Federal Savings and Loan Association. Benhardt Unanimous Consent of the City Council, as indicated by the following signatures: _ i~ QCs-° ~~> ~ z"'-L The attorney representing the San Diego Federal Savings & Loan has contacted the City Attorney requesting the release of that certain lien agreement between the City of Chula Vista and the Benhardts to allow for the canpletion of loan arrangements to Mr. and Nis. BP~hardt. It is felt that the release with the tens proposed and the substitution therefor of a pledge in the amount of $2,000 affords complete security to the City of Chula Vista. r..---__.. ~
