VELIER ENTERPRISE COASPANY The City Council of the City of Chula Vista does hereby resol~re as follows WiiEREAS, the City Council of the City of Chula Vista has heretofore imposed a moratorium on all construction in certain tide- lands and bayfront areas pending the completion and assess~ient of the study being prepared by Sedway/Cooke, and 1~JE3EREAS, it has now come to the attention of the City Council that heretofore, pursuant to that certain Agreement, dated July 1, 1969, allowing land development involving uncontrolled embankment between the City of Chula Vista and Samuel S. Vener Enterprise Company, said Samuel S. Vener Enterprise Company was authorized therein to deposit fill material upon certain properties located within the Bay Front Study area, and WiiEREAS, it is now deemed that continuation of such fill process will materially affect and alter the existing status of the Bay Front Area presently under study and will have a marked affect upon the area prior to the completion of the study which may be inconsistent with the recommendations contained therein and later adopted by the City of Chula Vista and the San Diego Unified Port District, and WHEREAS, the Director of Planning and the Director of Public Works have reco~~s~,e.^.ded to tree City Council that said agrn~ment b~~ ~us- pended concurrent with the moratorium period heretofore established. NOW, THEREFORE, BE IT RESOLVED that said Agreement dated July 1, 1969 by and between the City of Chula Vista and Samuel S. Vener Enterprise Company for land development involving uncontrolled embank- ment be, and the same is hereby, suspended to and until the completion of the study by Sedway/Cooke, and concurrent with the moratorium period heretofore established by the City Council. BE IT FURTHER RESOLVED that no further filling shall be authorized by Samuel S. Vener Enterprise Company for the period of this suspension. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to forward a certified copy of this Resolution to Samuel S. Vener Enterprise Company.
