RESOLUTION NO. 13356
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA DEFERRING UNDERGROUNDING REQUEST
AT 242 KENNEDY STREET (MONTESSORI SCHOOLS)
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City has approved a Major Use Permit PCC
87-29M for the temporary use of trailers on the site, and
WHEREAS, a time limit of three years to and until
December 1, 1990 has been established for the Major Use Permit.
%~HEREAS, in accordance with the City Code, he is
required to underground any overhead utility lines existing on
the parcel, plus undergrounding all-the utility services, and
WHEREAS, Mr. Harlan has applied for a deferral of thiS
requirement which is set for public hearing before the City
Council on November 24, 1987.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby find as follows:
A. That extraordinary conditions exist to the extent that
enforcement of Section 15.32.070 of the Chula Vista
Municipal Code would result in unnecessary hardship to
the owner or the utility company. Based on an estimate
by SDG&E, the conversion costs would be 25% of the cost
of the improvements on the property. The utility
service is for a temporary building and it is
unnecessary to require this to be undergrounded for a
short term when it will be accomplished at the time the
permanent building is constructed.
B. That such deferral will not, under the circumstances of
the particular case, be detrimental to the health,
safety or general welfare of the neighborhood because:
1. It is the City's intention to enforce the conversion
requirements when Mr. Harlan constructs his
additional permanent structure.
C. That the deferral of undergrounding applies only as long
as the Major Use Permit is in effect and that the issue
of undergrounding be returned to the City Council at the
same time the Major Use Permit it returned to the
Council.

BE IT FURTHER RESOLVED that the City Council does hereby
approve the deferral of the requirement to underground the
existing overhead distribution lines and the undergrounding of
the new service at 242 Kennedy Street (Montessori Schools).
