RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING SUPPLEMENTAL AGREEMENT "C" FOR MASTER
SIGNAL MAINTENANCE AGREEMENT FOR CONSTRUCTION AND
MAINTENANCE OF A TRAFFIC SIGNAL AT FIFTH AVENUE AND
"L" STREET AND AUTHORIZING THE MAYOR TO EXECUTE SAID
SUPPLEMENTAL AGREEMENT "C"
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain Supplemental
Agreement "C" for Master Signal Maintenance Agreement by and between
the CITY OF CHULA VISTA, a municipal corporation, and the COUNTY OF SAN
DIEGO, a political subdivision of the State of California, for the
construction and maintenance of a traffic signal at Fift~1 Avenue and
"L" Street in the vicinity of Chula Vista, dated the 5th day of
January , 1971, a copy of which is attached hereto and in-
corporated herein, the same as though fully set forth herein be, and
the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

SUPPLEI~'NTAL AGREEMENT "C" FOR MASTER SIGNAL
MAINTENANCE AGREEMENT I'OF CUNSTRLICTION AND
MAINTENANCE OF A TRAFFIC SIGNAL AT FIFTH AVENUE
AND "L" STREET
THIS SUPPLEIJiENTAL AGREEMENT "C", executed this day
of , 1971, by and between the CITY OF CHULA VISTA, a
municipal corporation, hereinafter called "City" and the COUNTY OF SAN
DIEGO, a political subdivision of the State of California, hereinafter
called "County";
W I T N E S S E T H
tti'HEREAS, the Master Traffic Signal Maintenance Agreement be-
tween the City of Chula Vista and the County of San Diego, dated the
2nd day of February, 1965, as approved by Resolution No. 3598, provides
for the addition of signals by a supplemental written agreement between
the City and the County, and
F?HEREAS, the intersection of Fifth Avenue and "L" Street,
located in the vicinity of Chula Vista, lies partly within the County
and partly within the City, and .
WHEREAS,~seventy-five percent (75%) of the approaches to said
intersection are under the jurisdiction of the City, and twenty-five
percent (25o) of the approaches to said intersection are under the
jurisdiction of the County, and
WHEREAS, City and County desire to enter into a supplemental
joint powers agreement to the Master Traffic Signal Maintenance Agree-
ment between the City and County, for the construction and maintenance
of a traffic signal system in this intersection.
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the City
and Cour_ty as follows
1. City shall prepare,plans and specifications for construc-
tion of a traffic signal system at.the intersection of Fifth Avenue and
"L" Street in the vicinity of Chula Vista. No construction shall begin,
however, until the plans and specifications for the traffic signal
system have been approved by the Director of Public Works on behalf of
the City and by the County Engineer on behalf of the County.
2. City shall provide and pay for all engineering design,
service and inspection to be performed prior to and during the construc-
tion of said project, and City will. pay all construction costs of the
project; provided, however, that County shall .reimburse City as specified
in Paragraph 3 of this supplemental agreement.
3. County shall reimburse City for twenty-five percent (250)
of the total construction cosfi expended by City for said traffic signal
system and for twenty-five percent (25o~) of the cost to City of engin-
eering, design, service and inspection prior to and during the construc-
tion of said project. Reimbursement pursuant to this Paragraph shall be
made within sixty (60) days following completion and acceptance of said
construction.
4. City hereby agrees to maintain, operate and repair the
entire installation, including the traffic signals, lighting system,
and to pay the cost of power therefor, subject to reimbursement by
County as specified in Paragraphs 5, 6, 7 and 8 of this supplemental
agreement.
5. City will furnish and perform all routine maintenance and
inspection services necessary to keep the facilities specified in Para-
graph 4 of this supplemental agreement in satisfactory working condition.
Such services shall include the following: patrolling, emergency service,
relamping, pa_inti.r.~g os standards and heads, necessary minor repairs and
adjustrlents, and replacement far routine maintenance purposes of con-
troller equipment, detectors, poles, heads and lamps. City shall supply
all necessary spare equipment; provided, however, that installation of
additional equipment or facilities shall not be considered routine
maintenance under the provisions of this paragraph. A flat monthly
rate of Two Dollars and Forty Cents ($2.40) per signal head shall be
paid to City by County for said routine maintenance and inspection.
City may adjust said monthly maintenance charge annually at the beginning
of each fiscal year; provided, however, that if City elects to adjust
said charges, it shall give County thirty (30) days written notice in
advance of the effective date of such adjustment.
6. City shall perform all extraordinary maintenance service,
including replacement and/or addition of major equipment required be-
cause of obsclescense, wear or inadequacy, and repair of extensive
damage due to vandalism, collisions, or any other cause. County shall
reimburse City for twenty-five percent {250) of the costs of labor,
parts and equipment used and/or actually expended in performing said
extraordinary maintenance.
7. Electrical energy costs for said traffic signal system
shall be paid by the City; provided, however that County shall reimburse
City for twenty-five percent (250) of the cost of such electrical energy.
8. City shall charge and County shall pay to City an addi-
tional amount equal of six percent (50) of the total sum to be paid to
City pursuant to Paragraphs 5, 6 and 7 of this supplemental agreement.
9. City shall bill County quarterly for the costs and charges
for the preceding quarter due to City pursuant to Paragraphs 5, 6, 7
and 8 of this supplemental agreement. Bills for extraordinary mainten-
ance, including both replacement and repair, shall show an itemization
of the costs of labor, parts and equipment used and/or expended in each
particular instance. Payment shall be made by County to the City
Finance Department within thirty (30) days after receipt of said bills.
10. This supplemental agreement may be terminated at any
time after the completion of the construction of the traffic signal
system by either party upon giving thirty (30) days prior written notice
of intention to terminate.
IN WITNESS WHEREOF, this Supplemental Agreement "C" to the
Master Signal Maintenance Agreement is executed by the City of Chula
Vista pursuant to action taken by its City Council and by the County of
San Diego pursuant to action taken by its Board of Supervisors.
