MAINTENANCE AGREEMENT FOR SOUTHWESTERN
COLLEGE SWIMMING POOL
THIS AGREEMENT, made and entered into this 5th day of
January , 1971, by and between the CITY OF CHULA VISTA, a
municipal corporation, hereinafter called "City", and the SWEETWATER
JUNIOR COLLEGE DISTRICT, hereinafter called "College District";
W I T N E S S E T H
WHEREAS, the City of Chula Vista and the Sweetwater Junior
College District have heretofore entered into an agreement, pursuant to
the provisions of Article 1 of Chapter 5 of Division 7 of Title 1 of
the Government Code of the State of California to construct a swimming
pool facility at Southwestern College, and
WHEREAS, said pool has now been completed and City and College
District will jointly use said pool in accordance with the terms and
conditions of the joint use agreement, and
WHEREAS, College District has requested that City provide
swimming pool maintenance for said pool, and
WHEREAS, City has sufficient personnel experienced in pool
maintenance and is therefore able to provide said maintenance.
NOW, THEREFORE, in consideration of the mutual covenants and
conditions contained herein, the parties hereto agree as follows:
ROUTINE POOL MAINTENANCE:
1. City agrees to provide routine pool maintenance on a
regular basis for that certain swimming pool located at Southwestern
College, which pool is jointly used by City and College District.
Said pool maintenance tasks shall include but are not necessarily
limited to the following: '
(a) Mechanical Room: Regulate, adjust and lubricate
valves and pumps; keep room clean; take test of water
in pools.
(b) Filter: Back-wash; precoat; inspection and replace-
ment of filter disc and anodes rods.
(c) Boiler: Inspect, regulate and adjust.
(d) Chlorine: Test for leaks; regulate amount required
for water treatment in accordance with State laws; main-
tain chlorinators and regulate amount of chlorine required;
replace empty chlorine cylinders furnished by college
as needed.
(e) Recommend need~l repairs to be performed by other
than City.
2. College District agrees to pay all labor charges for the
skilled City employee at the prevailing wage rate for the personnel in-
volved at a minimum labor charge of one (1) hour pay per required visit
to said swimming pool to accomplish said routine maintenance. Said time,
to be charged by City, shall include all travel time from said employee's
regular job assignment to the swimming pool, as well as the actual time
required for routine maintenance. Any of said travel time or routine
maintenance performed during other than normal working hours, i.e.,
7:00 a.m. to 3:30 p.m. seven (7) days per week except holidays, will be
billed at time and one-half of said regular labor costs. Said costs will
be billed to College District quarterly and will include labor only and

no overhead. College District shall also pay $2.00 per visit to cover
transportation costs, vehicle rental, small tools and other items normally
used in the performance of maintenance tasks.
3. College District further agrees to furnish all materials
required to carry out pool maintenance, as requested by City, including
but not necessarily limited to the following:
Chlorine
Soda-ash or alkalizer
Diatomaceous earth
Ammonia
Phenol Red

Orlhotolidine
Muratic Acid
Repair parts
Anodes
Disc covers
Lubricants
Tools unique
(seals, packing, etc.)

ITEMS EXCLUDED FROM POOL MAINTENANCE:
4. City and College District further agree that routine pool
maintenance will not include any major repairs such as the following:
Circulating pump or motor
(3) soda-ash pumps
Chlorine booster pump
Slurry feed pump
(2) submersible pumps
Copper pipes - exposed or underground
Transite pipes - exposed or underground
Repair valves - exposed or underground
Filter
Boilers
Major repair or replacement of pipes
Major electric repairs
Clearing of stoppages in underground sewer or drain pipes
Repair to filter tank lining
Chlorinator parts
Painting
5. This Agreement is subject to amendment by mutual consent
of the parties hereto, and may be terminated by either party by notice
in writing ninety (90) days prior to date of termination.
IN WITNESS WHEREOF, the parties hereto have caused this agreement
to be executed the day and year first hereinabove set forth.
