RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING THE ISSUANCE OF A
COASTAL DEVELOPMENT PERMIT TO THE CITY OF
CHULA VISTA REDEVELOPMENT AGENCY FOR THE
DEMOLITION OF A SINGLE FAMILY DWELLING UNIT
ON GUNPOWDER POINT AND REMOVAL OF DEBRIS FROM
THE IMMEDIATE AREA
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Chula Vista Bayfront Local Coastal Program (LCP)
was certified by the California Coastal Commission; and,
WHEREAS, said LCP includes coastal development permitting
procedures determined by the Coastal Commission to be legally adequate for
issuance of Coastal Development Permits; and,
WHEREAS, the City of Chula Vista has assumed permit authority
over the Chula Vista Coastal Zone; and,
WHEREAS, a public hearing was held on May 26, 1987, in accordance
with said permitting procedures; and,
WHEREAS, the City Council of the City of Chula Vista, as approving
authority has reviewed the proposal for demolition of the single family dwelling
unit on Gunpowder Point and associated debris.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Chula Vista finds, based on the following findings in accordance with Section
13311 of the California Administrative Code, that the demolition of the single
family dwelling unit on Gunpowder Point and removal of associated debris is
consistent with the policies of the Chula Vista Bayfront LCP.
1. The removal of the single family dwelling unit and debris from the
Nature Interpretive Center/Community-Neighborhood Park site is
consistent with the planned public usage of the site identified in
the certified LCP.
2. Grading for the demolition and debris removal is not permitted between
November 1 to April I to adhere to the LCP requirement which was
intended to minimize the potential for siltation in wetlands.
3. The Statewide and Regional Interpretive Guidelines have been reviewed
and the proposed demolition and debris removal has been found to be
in conformance with the Public Access and Public Recreational policies
of Chapter 3 of the Public Resources Code.
4. The demolition of the single family residence and removal of debris is
not considered new development pursuant to Section 30212 (b) (2) of the
Public Resources Code. As a result the demoliton and debris removal work
is not subject to the public access requriements for new development.
The demolition and debris removal will not, however, have adverse impacts
on lateral public access to the coastline.
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista hereby issues a Coastal Development Permit for the demolition of
a single family dwelling unit on Gunpowder Point and removal of associated
debris.
