DE MISSRI AND AUTHORIZING THE MAYOR TO EXECUTE SAID GRANT DEED The City Council of the City of Chula Vista does hereby resolve as follows: That the City of Chula Vista hereby remises and releases by grant deed that certain property known as Lot 8 of Palm Garden Estates to Moises J. Missri and Estherina C. de Missri, husband and wife, as joint tenants. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said grant deed, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein. MISSRI AND ESTHERINA C. DE MISSRI THIS AGREEMENT, made and entered into this 16th day of November , 1970 , by and between the CITY OF CHULA VISTA, a municipa corporation, hereinafter called "Seller" and MOISES J. MISSRI AND ESTHERINA C. DE MISSIRI, husband and wife, hereinafter called "Buyer"; W I T N E S S E T H; WHEREAS, Seller is the owner of certain real property, known as Lot 8 of Palm Gardens Estates, and WHEREAS, Buyer has heretofore made an offer to purchase said real property for the sum of $11,391.85. NO4vT, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. Seller agrees to sell, and Buyer agrees to purchase, that pertain real property situate in the City of Chula Vista, County of San Diego, State of California, known as Lot 8 of Palm Gardens Estates, and more particularly described as follows: - Lot 8 of Palm Gardens Estates according to Map No. 5383, filed May 4, 1964 in the office of the County Recorder, County of San Diego, State of California, excepting therefrom the southerly 80 feet thereof. 2. Buyer agrees to be bound by all conditions for the develop- ment of said property as contained in the covenants and restrictions, and more particularly, requirements for fencing that portion of the property adjacent to the proposed right of way for "H" Street. 3. The purchase price for said property shall be the sum of ELEVEN THOUSAND THREE HUNDRED NINETY ONE DOLLARS AND EIGHTY FIVE CENTS ($11,391.85), said amount to be deposited in an escrow covering the sale of said property upon the approval of this agreement by the City Council of the City of Chula Vista. Seller agrees to share all normal costs of escrow and to provide a good and valid title policy for said property.
