HomeMy WebLinkAboutReso 1987-13033 RESOLUTION NO. 13033 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING EXTENSION OF CONTRACT TIME FOR THE EASTLAKE ASSESSMENT DISTRICT 85-2 PROJECTS The City Council Of the City of Chula Vista does hereby resolve as follows: WHEREAS, on April 14, 1987, the City Council by Resolution No. 12979 approved an extension of contract time for the four projects contained in the EastLake Assessment District 85-2, and WHEREAS, the four contracts were extended to May 15, 1987, due to a delay in the delivery of a telemetry cable to be installed by each contractor, and WHEREAS, the telemetry cable arrived the last week of April as promised by the supplier, Aero K.A.P., Inc. of Los Angeles, however, the cable was not color coded as specified and required by the Otay Water District, and WHEREAS, the cable manufacturer (American Insulated Wire Corp.), can not deliver replacement cable until the second week of June 1987, and WHEREAS, the Otay Water District, in a letter dated May 8, 1987, recommends a contract time extension for the projects to July 31, 1987 so that by extending the contract times an additional month more than required for the telemetry cable to arrive and be installed, the contractors will be able to correct any problems which may show up and will have to be corrected. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve an extension of contract time for the EastLake Assessment District 85-2 projects to and until July 31, 1987. Project: Eastlake Pump Station 980 Zone, Phase II Eastlake Water & Sewer Piping III A Assessment District 85-2 Dear Mr. Lippitt: This letter is in regards to the telemetering wire for the above referenced projects. Otay District approved a particular wire manufactured by American Insulated Wire Corporation. The wire was specified with a special color code, special insulation and coating. This wire was pruchased through Aero K.A.P., Inc. in Los Angeles; Mr. Bob Stabler; 1-818-574-1704. The manufacturer took an exceptionally long time to make this wire. We understand that all three projects at Eastlake received the same wire and it was all manufactured incorrectly. The six pairs were not color coded. The pairs were only numbered. We immediately checked with Otay Water District for approval to use the wire as received. The wire was unacceptable to the District and replacement wire was immediately ordered. Attached, please find American Insulated Wire Corporation letter dated April 23, 1987 which is the latest information we have on delivery of the replacement wire. We would very much like to make some kind of arrangements to file a Notice of Completion on these two pro3ects. We would agree to the City witholding twice the value of the telemetering wire until it was completed and accepted. If you have any other suggestions, we would like to discuss them. As you may or may not be aware of the specifications were mis- interpreted at the factory and the wire, while it was completed on time, was the wrong color code. We have authorized Aero Kap to return the wire to American at a great loss to us since this wire will have to be scrapped. I can understand your problem with~the City questioning what wen~ wrong. You also requested I consider an alternative to accepting the projects prior to in- stallation of the telemetry cable which is scheduled to arrive the first week of June. In reference to the latter, District staff agrees with my decision to postpone acceptance until the cable arrives, is installed, and tested satisfactorily and all other related work on the projects are complete. As you know, the District and Olson Construction Company are in the process of starting up the pump station. At this time, a few electrical problems have to be resolved to continue start-up oper- ations next week. Yesterday, a 4160 volt to 110 volt step-down transformer blew out. This item will take six to eight weeks to replace. Also, 24-volt power to the Murphy control panel was not functioning properly. During running of the diesel engine, over- heating occurred which has to be resolved. As you can see, it is very difficult to estimate a completion date for these projects with so many unknowns. My best attempt is to pick some time in July, say July 31, 1987, to allow for the trans- former to be replaced. At that time, the items in question "should" be resolved and the projects ready to accept. Some may very well be ready to accept prior to that date. Please call if you have questions.
