HomeMy WebLinkAboutReso 1987-13029 RESOLUTION NO. 13029 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING THE ISSUANCE OF A COASTAL DEVELOPMENT PERMIT TO THE CITY OF CHULA VISTA REDEVELOPMENT AGENCY FOR THE REPAIR AND MAINTENANCE OF THE SOUTH LEVEE ROAD The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Chula Vista Bayfront Local Coastal Program (LCP) was certified by the California Coastal Commission; and, WHEREAS, said LCP includes coastal development permitting procedures determined by the Coastal Commission to be legally adequate for the issuance of Coastal Development Permits; and, WHEREAS, the City of Chula Vista has assumed permit authority over the Chula Vista Coastal Zone; and, WHEREAS, a public hearing was noticed and was held on May 12, 1 987, in accordance with said permitting procedures; and, WHEREAS, the City Council of the City of Chula Vista, as the approving authority has reviewed the south levee road repair and maintenance plans. NO~, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista finds, based on the following findings in accordance with Section 13311 of the California Administrative Code, that the south levee road repair and maintenance work is consistent with the policies of the Chula Vista Bayfront LCP. 1. The repair and maintenance of the south levee road is not considered new development pursuant to Section 30212{b) (5) of the Public Resources Code. As a result, the repair and maintenance work is not subject to the public access requirements for new development. The repair and maintenance of the south levee road will not, however, have adverse impacts on lateral public access to the coastline as it will allow access to the Nature Interpretive Center by shuttle bus. 2. Consistent with Section 30240{b) of the Public Resources Code, the repair and maintenance of the south levee road was sited and designed to prevent impacts which could significantly degrade the adjacent areas. The repair and maintenance of the road for use by shuttle buses is compatible with the continued use of the adjacent wildlife habitat areas. The foll owing measures were included in the project design to minimize potential environmental impacts: a. Engineering fabric and lumber were included in the project design to retain the aggregate to prevent it from entering the wetlands. b. A biologist or other knowledgeable, responsible party will be on-site to supervise the repair and maintenance work. The supervision will ensure that the contractor limits all construction activities and placement of aggregate to ~ surface of the existing south levee road and that no aggregate is placed on the sides of the existing levee. c. The contractor will be allowed only lO working days on the site to complete the repair and maintenance. d. Repair and maintenance activities will be staged from the Midbayfront, and all construction equipment will be stored in the Midbayfront at least 300 feet back from the wetland areas. 3. The Statewide and Regional Interpretive Guidelines have been reviewed and the proposed repair and maintenance of the south levee road will maintain the functional capacity of the adjacent environmentally sensitive habitat areas because it will not significantly degrade an environmentally sensitive habitat area. In addition, consistent with the Statewide Interpretive Guidelines, the City Council has set limits and conditions on the development. 4. The repair and maintenance of the existing south levee road will not preclude the improvements to that roadway specified in the Bayfront Specific Plan. 5. Grading for the south levee road repair and maintenance project i s not permitted between November 1 to April 1 to adhere to the LCP grading requirement which is intended to minimize the potential for siltation in wetlands. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista hereby issues a Coastal Development Permit for the south levee road repair and maintenance work.
