RESOLUTION NO. 13022
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA FINDING THAT THE USE OF TAXES
ALLOCATED FROM THE TOWN CENTRE II REDEVELOPMENT
PROJECT AREA FOR THE PURPOSE OF IMPROVING AND
INCREASING THE COMMUNITY'S SUPPLY OF LOW- AND
MODERATE-INCOME HOUSING OUTSIDE THE PROJECT AREA
WILL BE OF BENEFIT TO THE PROJECT AREA
WHEREAS, Section 33334.2 (a) of the California Health and Safety Code
provides that not less than 20 percent of all ("tax increment") which are
allocated to the Redevelopment Agency of the City of Chula Vista shall be used
by the Agency for the purpose of increasing and improving the community's
supply of "low-and moderate-income housing" available at affordable housing
cost to persons and families of low or moderate income and households, unless
one of the following findings is made:
l) That no need exists in the community, to improve or increase the
supply of low- and moderate-income housing in a manner which
would benefit the project area; or
2) That some stated percentage less than twenty percent (20%) of
the taxes which are allocated to the Agency pursuant to Section
33670 is sufficient to meet the housing need; or
3) That a substantial effort to meet low- and moderate-income
housing needs in the community is being made and that this
effort, including the obligation of funds currently available
for the benefit of the community from State, local, and Federal
sources for low- and moderate-income housing alone, or in
combination with the taxes allocated under this Section, is
equivalent in impact to the funds otherwise requi red of persons
and families of very low-, low- or moderate-income households
within or adjacent to the Project Area, because of increased
employment opportunities, or because of any other direct or
indirect result of implementation of the Redevelopment Plan.
WHEREAS, Section 710.1.3 of the Amended Town Centre II Redevelopment
Plan for the Chula Vista Redevelopment Project Area provides for such
allocation of tax increment; and
WHEREAS, Section 33334.2 (g) of the California Health and Safety Code
states that the Chula Vista Redevelopment Agency may use these funds inside or
outside the Project Area if, by resolution of the Agency and City Council, it
is found that such funds and the provision of low and moderate-income housing
outside the Project Area will be of benefit to the Project Area.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CHULA
VISTA CITY COUNCIL, AS FDLLOWS:
1) The City Council hereby finds that the use of funds pursuant to
Section 33334.2 (a) of the California Health and Safety Code and
the provision of low- and moderate-income housing outside the
Project Area, and/or the replacement of housing to be placed
outside the Project Area, if necessary, will be of benefit to
the Town Centre II Redevelopment Project Area.
2) This determination of the Agency, along with that of the Chula
Vista Redevelopment Agency shall be final and conclusive as to
the issue of benefit to the Project Area.
3) The City Council hereby acknowledges the adoption of a similar
finding of benefit relative to the use of funds outside the
Project Area for the provision of low- and moderate-income
housing by the Chula Vista Redevelopment Agency.
