HomeMy WebLinkAboutReso 1973-6800Form No. 342 Rev. 9-71 RESOLUTION NO. 6800 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND AMERICAN HOUSING GUILD FOR CITY PARTICIPATION IN THE CONSTRUCTION OF SEWER FACILITIES ADJACENT TO LARKHAVEN CHULA VISTA UNIT 3 CONCURRENT WITH THE INSTALLATION OF IMPROVEMENTS AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and AMERICAN HOUSING GUILD-SAN DIEGO, for City participation in the construction of sewer facilities adjacent to Larkhaven Chula Vista Unit 3 concurrent with the installation of public improvements, dated the 27th day of March , 1973 , a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the sum of $16,384.00 be, and the same is hereby appropriated from the Sewer Income Fund for the purpose set forth hereinabove. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. Their connect- ion charges, per Resolution 3709, would be $569. The Max Avenue Sewer Lift Station is already overloaded and cannot accept additional sewage. It would therefore be to the subdivider's advantage to construct this gravity sewer system. The subdivider proposed this agreement with the City of_ Chula Vista through which he would construct said sewer and would pay f_or 300 of the construction costs, less the $5,084 which has already been paid by other developers, and WHEREAS, it is generally accepted that it is desirable to construct the City`s portion of_ improvements concurrent with the installa- tion of_ improvements by the subdivider, and that because of the ready availability of construction equipment and elimination of certain work which is caused by stage construction, the work can be performed more economically than if it were to be accomplished separately, and WHEREAS, the following advantages would apply if the City of Chula Vista Caere to participate in the construction of said gravity sewer system rather than subsequently constructing said improvements through competitive bidding procedures: 1. Subdivider will be performing similar sewer construction in the immediate vicinity, anti consequently will have all necessary equipment and personnel available without additional move-on ccsts. 2. Unit. prices applicable to large projects are generally lower than those for smaller projects. Therefore, in combining the City's sewer construction with sewer construction in Larkhaven Chula Vista Unit 3, the subdivider is in a position to perform the work at the lesser rate and to pass some of said savings on to the City. 3. This se~ti-er system from Max Avenue to the northerly end of Lama Lane i_s Project. Number Ply'-5-73, Priority 7, in the 1973-7~1 Capital Improvement Yroram, recommended for funding of $26,000. Said proportionate share of the cost of said improvements will be paid to subdivider, American Housing Guild-San Diego, upon. completion and acceptance of said improvements by the City of Cliula Vista. 5. City further agrees to make partial payments of the full costs of said participation upon submission and verification of requests for_ payment, accompanied by paid vouchers, provided, however, that ter. percent (10~) of the proposed participation costs shall be held for a period of one (1) month subsequent to the completion and acceptance of said improvements in accordance with agreement executed by and between subdivider and City. IN WITNESS WHEREOF, the parties hereto have caused this agree- ment to be executed the day and year first hereinabove set forth.
