HomeMy WebLinkAboutReso 1970-5818RESOLUTION NO. 5818 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, URGING THE LEAGUE OF CALIFORNIA CITIES TO SUPPORT LEGISLATION AMENDING THE ANNEXATION LAWS OF THE STATE OF CALIFORNIA TO ALLOW, UNDER CERTAIN CIRCUMSTANCES, THE ANNEXATION OF TERRITORY TO CITIES WITHOUT THE CONSENT OF THE INHABITANTS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the present laws of the State of California require that the inhabitants of territory sought to be annexed to a municipality must consent to that annexation, and WHEREAS, the present laws provide no exceptions to said con- sent requirements, even in circumstances where annexation is logical and necessitated by facts which could be determined by a fact finding body, and WHEREAS, although compulsory incorporation of governmental areas has not been favored in the past, thirty-five states presently have come to the realization that the overall interests of the com- munity must at all times override the desires of the inhabitants of a territory to be annexed to a municipality, and WHEREAS, said sentiment in opposition to compulsory incor- poration may have been natural in an agrarian society but it is ill- suited to the needs of the most populous state in the nation in the decade of the seventies - the decade of the cities, and WHEREAS, the annexation or incorporation of territory without the consent of inhabitants has long been recognized by the Supreme Court of the United States as constitutional and not violative of the rights of due process of law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the League of California Cities be urged to continue to support, as it has done in the past, legislation which would, under specified conditions, allow for the annexation of territory without the consent of the inhabitants, and further, that the League take an even stronger position in respect to such legislation so that California will not be lacking in the ability to meet the demands of our times which clearly require the strong leadership role of the cities.
