HomeMy WebLinkAboutReso 1970-5817RESOLUTION NO. 5817 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, URGING THE LEAGUE OF CALIFORNIA CITIES TO SUPPORT AMENDMENTS TO THE DISTRICT REORGANIZATION ACT OF 1965, SETTING FORTH PROCEDURAL REQUIREMENTS AND POLICIES FOR LOCAL AGENCY FORMATION COMMISSIONS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, through the creation of local agency formation commissions in all counties throughout the state, the State of California has created the most powerful agency to control logical ~ growth and sound planning of all of the cities of the State of California, and to eliminate the multiplicity of special districts in the State of California, and WHEREAS, after nearly seven years of operation, it has become increasingly apparent that although the local agency formation commissions have made major contributions to both goals in some areas of the state, it must be recognized that they have fallen short of the mark in carrying out the intent of the legislation, e.g., there are today more special districts in the State of California than there were at the time of the creation of the local agency formation commissions, and cities in many areas continue to grow in a haphazard manner, often thwarted in their desire to intelligently incorporate areas which constitute logical annexations by local agency formation commissions which are not completely dedicated to the goals of the legislation, and WHEREAS, it is virtually impossible to challenge the decisions of the commissions because they function in a legislative capacity and the courts are not willing to substitute their judgment for the wisdom of said decisions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the League of California Cities be urged to recommend and support legislation amending the District Reorganiza- tion Act of 1965, to establish mandatory directions for all local agency formation commissions, which would require that the commissions take positive actions in behalf of the cities, and in all cases where the alternatives for providing services to unincorporated areas are either through a special district or from a city by means of annexation or contract with county service areas, that the commission must, if at all feasible, direct that said services be provided by the cities. BE IT FURTHER RESOLVED that the League be urged to support legislation establishing procedural guidelines and requirements for fact finding on the part of local agency formation commissions, thus establishing the commissions as administrative bodies whose determina- tions would be subject to review by the courts.
