Home My WebLink AboutReso 1970-5815RESOLUTION NO. 5815 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, AUTHORIZING THE PAYMENT OF THE CLAIM OF HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF SAN DIEGO FOR THE PURPOSE OF CREDITING ASSESSMENTS OF THE SWEETWATER VALLEY INDUSTRIAL PARK PROJECT NO. 60-1, IN ACCORDANCE WITH RESOLUTION NO. 5511 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has heretofore determined, by Resolution No. 5511, adopted on the 20th day of January, 1970, that a surplus in the amount of $52,948.70 exists in the construction fund of the Sweetwater Valley Industrial Park Project No. 60-1, and WHEREAS, said resolution declared that said surplus shall be applied as a credit for said industrial park project, and WHEREAS, the affidavit of ROBERT F. ADELIZZI, setting forth the claim of Home Federal Savings and Loan Association of San Diego to said surplus has been received by the City of Chula Vista, a copy of which affidavit is attached hereto marked Exhibit "A", and made a part hereof by reference, and L~HEREAS, said affidavit states under penalty of perjury that all assessments on properties sold by Home Federal Savings and Loan Association of San Diego in said Sweetwater Valley Industrial Park have been paid in full, and that all surplus contained in the special trust fund established subsequent to the completion of improve- ments in the Sweetwater Valley Industrial Park are now due and owing to Home Federal Savings and Loan Association of San Diego in accordance with the provisions of Section 5132.1 of the Streets and Highways Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, in recognition of the affidavit of ROBERT F. ADELIZZI, attached hereto as Exhibit "A", and in accordance with the terms and provisions of Resolution No. 5511 adopted on the 20th day of January, 1970, and of Section 5132.1 of the Streets and Highways Code, that the sum of $52,948.70 be paid to Home Federal Savings and Loan Association of San Diego. BE IT FURTHER RESOLVED that the Finance Officer of the City of Chula Vista be, and he is hereby authorized and directed to forward a warrant in the amount of $52,948.70 to said Home Federal Savings and Loan Association of San Diego. BE IT FURTHER RESOLVED that said sum shall first be applied to any bonds remaining on Block 5 of said industrial park, and any funds remaining thereafter shall be applied to any bonds remaining on Block 4 of said industrial park, and that the Finance Officer of said City be, and he is hereby authorized and directed to assist representa- tives of Home Federal Savings and Loan Association by furnishing specific numbers of bonds remaining on said Block 5 and/or Block 4 of said Sweetwater Valley Industrial Park.
