SUMMARY
The City received a $135,630 Bicycle Transportation Account (BTA) grant from the California
Department of Transportation (CalTrans) in Fiscal Year 2008/2009 and appropriated to a Capital
Improvement Project, TF369 "Three Part Bicycle Facilities Improvement" for expenditure. The
BTA grant provided for City-wide bicycle amenities such as replacement of bus-mounted bike
racks, roadway signage for bicycle facilities and traffic signal. video- detection units in order to
encourage alternative modes of transportation. Bus-mounted bike racks were purchased as
provided for by the grant and reimbursed to the City, however, at time of installation they were
identified as being incompatible with the buses due to California Vehicle Code (VC) 35400.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 1(c) categorical exemption pursuant to Section 15301 (Existing Facilities) of the State
CEQA Guidelines because the proposed appropriation of funding will result in the installation of
bicycle amenities on buses and existing city roadways with no expansion of an existing use.
Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
This BTA grant provided fiords for athree-part bicycle facilities improvement grant that would
provide for, including but not limited to, bus-mounted bike racks. The cost approval is broken
down as follows:

Three-position bus mounted bike racks were purchased in FY 2009-10, after consultation and
approval by the San Diego Metropolitan Transit System's (MTS) former Director of
Maintenance, and subsequently reimbursed by CalTrans in July 2010. At installation, the racks
were identified as being incompatible with the buses. The three-position bike racks were
removed and MTS arranged for the exchange at no net cost for upgraded stainless steel, two-
position bus mounted bike racks. Subsequently, the two-position bike racks were deemed as not
an eligible expense from the BTA grant and CalTrans requested reimbursement in the amount of
$20,726. However, Transit elected to keep the bike racks and pay for them from the Transit
Fund. The two-position bus mounted bike racks will be installed as replacements, when needed,
and on new MTS-Chula Vista bus orders.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site
specific and consequently the 500 foot rule found in California Code of Regulations section
18704.2(a)(1) is not applicable to this decision.
CGRRENT YEAR FISCAL IMPACT
There is no impact to the General Fund. The Transit Division has elected to exchange the three-
position bike racks for two-position bike racks at no net cost whereby the Transit Fund will
reimburse the BTA fund for the expense in the amount of $24,750 minus $4,024 project
retention held by Caltrans for a total of $20,726.
In order to process the refund to CalTrans, the expenditure category of the BTA fund will be
amended for Fiscal Year 2011-12 to allow for the appropriation of $20,726.
A breakdown of the amount to be returned to CalTrans is as follows:

ONGOING FISCAL IMPACT
There is no ongoing fiscal impact. The transaction was aone-time occurrence.

WHEREAS, the City received a $135,630 Bicycle Transportation Account (BTA) grant
from the California Department of Transportation (CalTrans) in Fiscal Year 2008/2009 and
appropriated the funds to a Capital Improvement Project, TF369 "Three Part Bicycle Facilities
Improvement" for expenditure; and
WHEREAS, this BTA grant provided funds for a three-part bicycle facilities
improvement grant that would provide for, including but not limited to, bus-mounted bike racks;
and
WHEREAS, the cost approval is broken down as follows:
TOTAL $135,630 $15,070 $150,700
and
WHEREAS, three-position bus mounted bike racks were purchased in FY 2009-10 at a
cost of $24,750; and
WHEREAS, CalTrans reimbursed the City for the expenditure in the amount of $20,726,
the cost of the bike racks less a 10% retention, in July 2010; and
WHEREAS, during the installation, the racks were found to be incompatible with the
buses, removed, and exchanged, at no net cost, for two-position, bus-mounted bike racks, and
WHEREAS, subsequently, CalTrans determined that the two-position bike racks were
not eligible expenses from the BTA grant and requested a refund in the amount of $20,726; and
WHEREAS, the Transit Division, having elected to keep the two-position bike racks, will
reimburse the BTA fund from the Transit Fund the full cost of the two-position bike racks; and

WHEREAS, with the BTA fund made whole, it will refund the $20,726 to CalTrans for
the ineligible expenses.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby amend the Transfers Out expenditure category of the Transit Fund for Fiscal
Year 2011-12 by appropriating $24,750 for transfer into the Bicycle Transportation Account
(BTA) fund and amend the Other Expenses category of the BTA fund for Fiscal Year 2011-12
by appropriating $20,726 for refund to Caltrans.
