ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c}(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION Under California Penal Code Section 4025, an Inmate Welfare Fund is mandated to provide services essential to the benefit, welfare and educational needs of the inmates confined in the detention facilities. The money deposited into the Inmate Welfare Fund includes commission attributable to the use of pay telephones that are primarily used by inmates while incarcerated, along with sales from the jail commissary. The jail 11-1 12/06/2011, Item Page 2 of 2 commissary allows inmates to purchase supplies necessary for their comfort, sanitation and welfare. Such supplies are candy, snacks, writing materials and hygiene items. Inmate welfare funds may not be used to pay for required expenses of confining inmates in a local detention system, such as meals, clothing, housing or medical services. The City has established an interest-bearing fund outside the General Fund for the Inmate Welfare Fund. The Police Department is requesting an appropriation of $20,000 to purchase fitness and recreation equipment for jail inmates from the available balance of the Inmate Welfare Fund. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in a one-time appropriation of $20,000 to the supplies and services category of the Inmate Welfare Fund. There is no fiscal impact to the General Fund. ONGOING FISCAL IMPACT There is no ongoing fiscal impact for approving this one-time appropriation. ATTACHMENTS None.
