RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING A SUPERCEDING FREEWAY
AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND
STATE OF CALIFORNIA DEPARTMENT OF
TRANSPORTATION (CALTRANS) FOR INTERSTATE 805
(I-805) FROM THE SOUTH CITY OF CHULA VISTA LIMITS
TO THE EAST NAPLES STREET UNDERCROSSING
WHEREAS, each freeway within the City of Chula Vista is the subject of a Freeway
Agreement between Chula Vista and the State; and
WHEREAS, a Freeway Agreement grants the State authority to make adjustments to the
City street system in order to develop the portions of the associated freeway that aze within the
City; and
WHEREAS, the Freeway Agreement for Interstate-805, FMA 11-8061, was executed on
July 1, 1968, and covers I-805 from the south City limits (Otay Valley Road) to the City of San
Diego (03 miles north of Imperial Ave.); and
WHEREAS, Caltrans is currently working on the I-805 Direct Access Ramp project that
will provide a new access to/from I-805 to East Palomar Street; and
WHEREAS, the proposed improvements will provide express lanes that will be free for
high occupancy vehicles (two or more occupants), buses and motorcycles; and
WHEREAS, the express lanes will also be made available for single occupancy vehicles
using the electronic FasTrak transponder system; and
WHEREAS, this particular project was not addressed within the original Freeway
Agreement for I-805; therefore an amendment, called a Superceding Freeway Agreement
("SFA"), covering the south Chula Vista limits at post mile 3.4 to the East Naples Street
undercrossing at post mile 5.6, must be approved in order for the project right-of--way and
construction phases to be authorized; and
WHEREAS, the balance of the 1968 agreement will remain in effect; and
WHEREAS, the Development Services Director has reviewed the proposed activity for
compliance with the California Environmental Quality Act (CEQA) and with the National
Environmental Policy Act (NEPA) since this is a federally funded project, and has determined
that the activity, consisting of approval a Superceding Freeway Agreement with Caltrans that
will provide for a new Direct Access Ramp (DAR) to and from I-805 at East Palomar Street is
adequately covered in previously certified Final Environmental Impact Report
(FEIR)/Environmental Assessment (EA) with Finding of No Significant Impact for the Interstate

805 Managed Lanes South Project. The Final EIR/EA was prepazed by the State of California
Department of Transportation (Caltrans) and certified on June 22, 2011 pursuant to Division 13,
California Public Resources Code and Title 42, USC 4332(2)(C). The City of Chula Vista was a
Responsible Agency in the EIR/EA approval process. Thus, no further CEQA or NEPA
environmental review or determination is necessary; and
WHEREAS, the noticing and meeting for this action aze in compliance with California
Streets and Highways Code §100.22.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby approve the Superceding Freeway Agreement between the City of Chula Vista
and the State of California Department of Transportation (Caltrans) for Interstate 805 from the
south City of Chula Vista Limits to the East Naples Street Undercrossing.
