RESOLUTION OF THE C~TY COUNCIL OF THE C~
CHULA VISTA APPROVING AGREEMENTS FOR REP T
OF FUNDS ADVANCED FOR CONSTRUCTION OF DEFERRED
IMPROVEMENTS IN "D" STREET AND AUTHORIZING THE
MAYOR TO EXECUTE SAID AGREEMENTS
The City Council of the City of Chula Vista does hereby
resolve as follows:

WHEREAS, during the construction of the street f
improvements in Las Flores Drive and "D" Street, six property ~
owners entered into letter agreements with the City to install
their deferred public improvements in return for an agreement to
repay the funds advanced for construction, and
WHEREAS, three of the six property owners have returned
their executed agreements for repayment of their deferred
improvements, and it would now be appropriate for the Council to
approve said agreements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve the agreements for
repayment of funds advanced for construction of deferred
improvements in "D" Street between the City of Chula Vista and
Frank J. and Mary A. Williams; Janice R. Vrendenburgh and Ernest
Palacio and Leticia O. Rico.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreements for and on behalf of the City.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby authorized and directed to record said agreements for
and on behalf of the City of Chula Vista.
BE IT FURTHER RESOLVED that the Director of Finance is
hereby directed to collect the funds and reimburse Gas Tax Fund
Account 250-3860.

AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND
LETICIA O. RICO AND ERNEST PALACIO FOR REPAYMENT
OF FUNDS ADVANCED FOR CONSTRUCTION OF
DEFERRED IMPROVEMENTS IN D STREET
WHEREAS, the City Council of the City of Chula Vista,
per Resolution No. 7447, entered into an agreement with
Anthony J. Costello and Thomas Lewis for the deferral of the
installation of public improvements, and
WHEREAS, Leticia O. Rico and Ernest Palacio, hereinafter
"Owners", are the successors in interest to Anthony J. Costello
and Thomas Lewis, and
WHEREAS, the City later entered into a letter agreement
with Owners to install the deferred street improvements in return
for an agreement to repay the funds advanced for construction, and
WHEREAS, the total cost of improvements to the City
related to Parcel No. 566-300-48 is $10,885.32, and the amount
subject to the deferral agreement is ~6,000, and
WHEREAS, the Owner acknowledges that the ~4,885.32
difference between the amount covered in the deferral agreement
and the total reimbursement due to the City may be collected by
the City at such time as the property owner or its successors
seek a building permit or a subdivision approval.
NOW, THEREFORE, the parties do hereby agree as follows:
1. That the property owner or her successors in
interest shall repay the City for the cost of construction of
deferred improvements now installed in the amount of ~6,000.00
over the next ten (lO) years at a simple interest rate of 7% per
year on the balance as set forth below:

2. The City agrees that it will not take any action to
enforce the deferral agreement so 1 ong as the property owner
meets the payment schedule set forth in 1 above.
3. The deferral agreement and lien shall remain in full
force and effect until such time as the entire loan for deferred
improvements is repaid. At that time, the lien shall be

WHEREAS, the City Council Of the City of Chula Vista,
per Resolution No. 8484, entered into an agreement with Mabel I.
Lovell for the deferral of the installation of public
improvements, and
WHEREAS, Frank J. and Mary A. Williams, hereinafter
"Owners", are the successors in interest to Mabel I. Lovell, and
WHEREAS, the City later entered into a letter agreement
with Owners to install the deferred street improvements in return
for an agreement to repay the funds advanced for construction, and
WHEREAS, the total cost of improvements to the City
related to Parcel No. 566-300-51-01 is $5,170.57, and the amount
subject to the deferral agreement is $3,515.00, and
WHEREAS, the parties acknowledge that the $1,655.57
difference between the amount covered in the deferral agreement
and the total reimbursement due to the City may be collected by
the City at such time as the property owner or its successors
seek a building permit or a subdivision approval.
NOW, THEREFORE, the parties do hereby agree as follows:
1. That the property owners or their successors in

FUNDS ADVANCED FOR CONSTRUCTION OF DEFERRED
IMPROVEMENTS IN D STREET
WHEREAS, the City Council of the City of Chula Vista,
per Resolution Nos. 8573 and 8589, entered into an agreement with
Henry F. and Agnes L. Jahn for the deferral of the installation
of public improvements, and
WHEREAS, Janice R. Vredenburgh, hereinafter "Owner", is
the successor in interest to Henry F. and Agnes L. Jahn, and
WHEREAS, the City later entered into a letter agreement
with Owner to install the deferred street improvements in return
for an agreement to repay the funds advanced for construction, and
WHEREAS, the total cost of improvements to the City
related to Parcel No. 566-330-49 is ~7,517.28, and the amount
subject to the deferral agreement is ~7,500, and
WHEREAS, the parties acknowledge that the ~17.28
difference between the amount covered in the deferral agreement
and the total reimbursement due to the City may be collected by
the City at such time as the property owner or its successors
seek a building permit or a subdivision approval.
NOW, THEREFORE, the parties do hereby agree as follows:
1. That the property owner or her successors in
interest shall repay the City for the cost of construction of
deferred improvements now installed in the amount of ~7,500.00
over the next ten (10) years at a simple interest rate of 7% per
year on the balance as set forth below:
