RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA

AFL-CIO, FOR. FISCAL YEAR 1973-74
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the P-Zanagement Negotiation Team representing the
City Manager of the City of Chula Vista, acting for and on behalf of
the City Council of the City of Chula Vista, have heretofore met and.
conferred with Local 2180, International Association of Fire Fighters,
AFL-CIO, an organization representing members of the Chula Vista Fire
Department from Fireman up through the rank of Fire Captain, in accor-
dance with the provisions of Section. 3500 et seq. of the Government
Code of the State of California, and
WHEREAS, the Memorandum of Understanding jointly prepared
by said parties as a result of meeting and conferring has been pre-
sented to the City Council and is contained in Exhibit "A", attached
hereto and incorporated herein by reference as if set forth in full.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve and accept said Memorandum
of Understanding as contained in Exhibit "A" for fiscal year 1973-74.

MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER TERMS AND
CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND
LOCAL 2180, INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS AFL-CIO,
FOR FISCAL YEAR 1973-74 (July 1, 1973 - June 30, 1974)
[~7HEREAS, the representatives of the City Manager of the City of
Chula Vista, acting for and on behalf of the City Council of the City
of Chula Vista, have heretofore met and conferred with Local 2180,
International Association of Fire Fighters, AFL-CIO, an organization
representing members of the Chula Vista Fire Department from Fireman
up through the rank of Fire Captain, in accordance with the provisions
of Section 3500 et seq. of the Government Code of the State of
California, and
6VHEREAS, as a result of meeting and conferring in good faith with
said group, agreement has been reached on the following terms and
conditions of employment as applied to those employees who are members
of and represented by Local 2180, and said representatives of the
City Manager and of Local 2180 do now jointly prepare a written
Memorandum of Understanding concerning said agreed terms and condi-
tions of employment for presentation to the City Council of the City
of Chula Vista for determination, to-wit:
PREAMBLE
This agreement is entered into by and between City of Chula Vista,
hereinafter referred to as the Employer, and Local 2180 International
Association of Fire Fighters, hereinafter referred to as the Union.
It is the purpose of this agreement to achieve and maintain harmonious
relations and full communications between the Employer and the Union,
to provide for equitable and peaceful adjustment of differences which
may arise, and to establish proper standards of wages, hours and
other conditions of employment.
RECOGNITION:
The Employer recognizes the Union as the exclusive bargaining agent
for all Fire Captains, Fire Engineers, Fire Fighters and any other
equivalent uniformed class of the Fire Department. Those holding the
rank of Battalion Chief, Assistant Fire Chief, and Fire Chief are
excluded from representation by this bargaining unit.
WAGES:
1. City hereby agrees to a two and one-half per cent (220) salary
increase for members of the Chula Vista Fire Department from
Fireman up through the rank of Fire Captain. This salary
increase to become effective July 1, 1973.

2. City hereby agrees to a two and one-half per cent (2Zo) salary
increase for members of the Chula Vista Fire Department from
Fireman up through the rank of Fire Captain. This salary
increase to become effective January 1, 1974.
MEDICAL AND INSURANCE COVERAGE:
1. The following changes shall be incorporated in the employees'
medical and insurance coverage. These changes shall be paid
for by the City of Chula Vista, effective July 1, 1973.
a. Life insurance coverage shall be increased to $3,000.
b. Basic hospital room and board coverage shall be increased
to $45 per day.
c. Change from $100 deductible per each cause to $100 for
all causes, the deductible to be paid once each calendar
year.
d. Major medical maximum coverage shall be increased to
$50,000.
2. The following changes shall be incorporated in the dependents'
medical insurance. Total cost of dependents° medical insurance
shall be paid by the City of Chula Vista, effective January 1,
1974.
a. Basic hospital room and board coverage shall be increased
to $45 per day.
b. Change from $100 deductible per each cause to $100 for
all causes, the deductible to be paid once each calendar
year.
c. Major medical maximum coverage shall be increased to
$50,000.
SICK LEAVE REIMBURSEMENT:
Civil Service Rule I~, Section 3, shall be amended to include Fire
Department Personnel represented by Local 2180, International Asso-
ciation of Fire Fighters AFL-CIO.
Fire service employees on a 60-hour work week using 48 hours of sick
leave, or less, during the fiscal year, shall have the option of
converting twenty-five per cent (25%) of their remaining yearly sick
leave to pay. If the pay option is not selected, all remaining
yearly sick leave shall be carried over and accumulated.

Fire service employees on a 40-hour work week will be subject to the
same sick leave reimbursement plan as provided for miscellaneous
employees, as found in Civil Service Rule II, Section 3a.
Pay shall be computed based on the following schedule and all
computations shall be rounded to the nearest whole hour:

This benefit becomes effective July 1, 1973; however, payment made for
the period from July 1, 1973, to June 30, 1974, during July, 1974, will
be computed at one-half (1/2) the normal entitlement, or 12.5. There-
after, such benefit will be on a basis equal to the 25$ factor utilized
regarding regular miscellaneous employees.
UNIFORM ALLOWANCE:
Members of the Fire Department from Fireman up through the rank of
Fire Captain shall receive a uniform allowance as follows:
An annual allowance of one hundred dollars ($100) for
uniform and equipment maintenance. Said annual allowance
to be paid on a fiscal year basis with no carryover from
year to year.
This benefit becomes effective January 1, 1974. Payment made during
January, 1974, shall be fifty dollars ($50), based on a six-month
entitlement period.
THREE PLATOON AD HOC STUDY COMMITTEE:
An ad hoc committee shall be established during the fiscal year
1973-74 to study the feasibility and ramifications of implementing
a three platoon system within the Chula Vista Fire Deparment. At
least one member of the committee shall be appointed and represent
the local Union.

DEPARTMENTAL OPERATIONS AND SAFETY ADVISORY COMMITTEE:
A committee shall be established during the fiscal year 1973-74
comprised of 3 representatives of the Union and at least 3 members
of Management, which shall meet no less than once a month on a
scheduled basis. Additional meetings may be called by either party
subject to 10 calendar days notice. All meetings shall be subject
to an agenda of items pertaining to any operational matter, with
special emphasis in the area of employee or public safety. It is
understood that these meetings will provide a means whereby the
Union will be consulted regarding significant future changes to
negotiated employee benefits and working conditions. The nature
of these meetings will be to explore areas of concern, to improve
communications, and to provide a basis for interchange of ideas.
Any proposal agreed to by a majority of this group will be forwarded
to the City Manager's office and will receive a written response
from the City Manager in that regard. It is understood that it is
not the function nor intent of this committee to infringe on manage-
ment rights, but in a consultive way to perform meaningful advisory
services to management.
PAYROLL DEDUCTION OF DUES:
The employer agrees to deduct, once each pay period, dues and
assessments in an amount certified to be current by the Secretary-
Treasurer of the Local Union from the pay of those employees who
individually request in writing that such deductions be made. The
total amount of deductions shall be remitted by the Employer to the
Treasurer of the Union. This authorization shall remain in full
force and effect during the term of this agreement.
DISCRIMINATION:
The Employer agrees not to discriminate

Section 1. Up to three (3) designated members of the Union negoti-
ating team are authorized time off duty for participation in all
meetings to be mutually scheduled by the Employer and the Union.
Section 2. Employees elected to Union office and/or to the Board
of Directors of the Union are authorized to conduct meetings of
the Officers and/or Board of Directors in City facilities during
duty hours, at no cost to the City.

Section 3. The Employer shall provide distribution of the following

The Employer agrees to furnish and maintain space for suitable bulle-
tin boards in convenient places in each station and work area to be
used by the Union. The Union shall limit its posting of notices
and bulletins to such bulletin boards.
OVERTIME PAY:
In the event that a need for overtime should occur in the Fire
Department because of an emergency, sickness or other unforeseen
conditions, overtime shall be paid at one and one-half times the
basic rate of pay.
If overtime is worked at the end of the employee's regular shift,
the employee shall receive a minimum of two hours of overtime pay.
Any time less than thirty (30) minutes shall not be considered as
overtime pay.
All employees covered by the terms of this agreement who are called
back to work from off duty shall be paid at least two (2} hours
minimum at one and one-half times the basic rate of pay.
RESPONSIBILITY FOR EQUIPIMENT:
The City will hold employees harmless for equipment damaged or lost,
except for acts of gross negligence, vandalism, or intoxication.
SHIFT EXCHANGE:
Subject to a Shift Commander's approval, employees shall have the
right to exchange shifts or parts of shifts when the change does not
interfere with the operation of the Fire Department.

DEATH IN FAMILY LEAVE:
In the event of a death in the immediate family of an employee,
the employee shall be granted up to two (2) shifts off with pay.
The immediate family shall be defined as spouse and children of
the member, mother, father, brother, sister of the member, and
those of the member's spouse as approved by the Civil Service Com-
mission, or any other person as defined by the Internal Revenue
Service as a dependent. Paid absence for family death shall be
charged to accumulated sick leave. It is understood that the City
Manager will recommend this change to the Civil Service Commission.
UNION REPRESENTATION:
Section 1. A Shop Steward shall be any bargaining unit member
designated in writing by the elected Union President. The Union
shall provide and maintain a current list of designated Shop
Stewards, not to exceed eight (8) in number, and such lists shall
be filed with the Office of the City Manager and the Fire Chief.
Section 2. The City grievance procedure will be adhered to on any
matter which appropriately falls under that procedure. Any other
matter which is within the scope of representation regarding the
Union may also be discussed on a special basis at a time to be
mutually agreed upon by both parties, Management and the Union.
It is understood that reasonable advance notice of 10 calendar days
is required unless both parties consent to a shorter period in the
interests of expediting the handling of a matter.
EMPLOYEE PERSONNEL RECORDS:
Any member shall be entitled to see the contents of his personnel
records. Availability of these records to the employee will be
subject to the normal business hours affecting the position or
office who has routine custody of these records.
Any letter of reprimand, as defined in Administration Regulation
dated September 25, 1972, included in the personnel records of any
member of the bargaining unit shall be removed from the record one
year from the date of the letter, if such employee has a current
performance rating of satisfactory or better. The scope of removal
does not apply to any other document which may mention the specific
letter of reprimand, such as an employee performance report or other
documents which may only refer to the reprimand as a matter of
reference.

MILEAGE ALLOWANCE:
If Fire Service employees are required to use their private auto-
mobiles for Fire Department business, such as in changing duty
stations, once they have reported to their assigned duty station
they will receive mileage reimbursement at the rate of 10~ per
mile.
CLEAN-UP TIME:
Except in cases of fire or other emergencies, Employees shall be
granted thirty (30) minutes personal clean-up time prior to the
end of each working shift.
VACANCIES - PROMOTIONS:
When a permanent vacancy occurs in any position, it shall be filled
in accordance with Civil Service Rule V, Section 1.
PERSONNEL REDUCTION:
In the case of a personnel reduction of permanent employees,
employees with unsatisfactory ratings shall be laid off first.
Thereafter, the order of layoffs shall be in the reverse order of
seniority within the classification in which the layoff is being
made.
While this agreement is in effect, no new employee shall be hired
until the laid-off employees with satisfactory or better ratings
have been given the opportunity to return to work.
CONTINUATION OF EXISTING BENEFITS:
It is further understood and agreed that any other benefits and work-
ing conditions and the terms and conditions thereof presently in
effect shall remain unchanged (except for amendments to the Civil
Services Rules which liberalize employee benefits) unless and until
said terms and conditions shall be modified as a result of meeting
and conferring in good faith between the City and the Chula Vista
Fire Fighers Local Union 2180, AFL°CIO, pursuant to the provisions
of Section 3500 of the Government Code of the State of California.

SAVINGS CLAUSE:
If any provision of this agreement, or the application of such pro-
vision, should be rendered or declared invalid by any court action
or by reason of any existing or subsequently enacted legislation,
the remaining parts or portions of this agreement shall remain in
full force and effect.
