HomeMy WebLinkAboutReso 1973-6820RESOLUTION NO. 6820 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DECLARING ITS INTENTION TO GRANT A LICENSE FOR TEMPORARY MASTER ANTENNA SYSTEM IN THE RANCHO RIGS AREA IN THE CITY OF CHULA VISTA The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Resolution No. 6689 provides for the establishment of temporary master antenna television systems in the City of Chula Vista and a process for licensing said systems, and WHEREAS, the City of Chula Vista has received an applica- tion for such a license from the Rancho Rios Antenna System, a copy of which is attached hereto and incorporated herein by reference as if set forth in full, and WHEREAS, the City Council pursuant to said Resolution No. 6689 is required to set a public hearing to consider said applica- tion. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that a public hearing be set to determine whether or not a license should be issued to Rancho Rios Antenna System for the establishment of a temporary master antenna system in the Rancho Rios area in the City of Chula Vista. BE IT FURTHER RESOLVED that Tuesday, the 1st day of May, 1973 at 7:00 p.m. in the Council Chambers of City Hall, 276 Fourth Avenue, Chula Vista, California is hereby set as the time and place for hearing all persons interested in or objecting to said license. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to publish said notice in a newspaper of general circulation in the City of Chula Vista at least ten (10) days prior to said hearing. A map of Chula Vista showing the location of the proposed license area is filed as Exhibit A. A description and map of the bound- aries showing the location of the proposed license area within the City of Chula Vista is filed as Exhibit B. A schedule of the proposed charges and rates is filed as Exhibit C. Rancho Rios Antenna System is a California partnership composed of Rancho Rios Developers, itself a partnership, and Design Electronics, Inc., a California corporation doing business as San Diego Antenna Systems, as general partners. There are no limited partners. The proposed licensed area is largely owned and being developed by Rancho Rios Developers, one of applicant's partners, is a master planned development in accordance with the rules, regulations and requirements of the City of Chula Vista. The City of Chula Vista's policy of having all utilities placed under- ground is being followed. Deed restrictions will, or have been placed on the various units being developed prohibiting individual antennas in order to forestall an unsightly skyline. Rancho Rios Antenna System has provided in its partnership agreement to furnish all master community antenna and cable service to all homes, apartments and businesses in the various portions of the license area as they are developed. Design Electronics, Inc., one of applicant's partners, has itself, or through its subsidiarie s, had many years of experience in San Diego County and in the City of Chula Vista in the construction of master antennas and CATV systems. Currently the company is engaged in CATV construction for Southwestern Cable (a subsidiary of Time-Life, Inc.) in the Scripps Ranch area. Television reception without a master community or CATV system in many portions of the license area is very poor and a master antenna or a CATV system is needed in the area in question. Mission Cable, owner of the present CATV franchise in the City of Chula Vista including the area for which applicant seeks a master antenna license, is not prepared for some time to furnish CATV or master antenna service to the area. Therefore, a temporary master antenna service is required now. Also, it would be much more expensive to install a system later after all the streets have been paved. Applicant's master antenna system will be constructed in accordance with the technical specifications required by Mission Cable for the area in question. Therefore, should Mission event- ually acquire applicant's system in accordance with the provisions of Resolution No. 6689 there will be no problem in integrating this system with Mission's CATV operation in the City of Chula Vista . Applicant will be prepared to offer services upon granting of a license.
