RESOLUTION NO. 6801
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND AMERICAN HOUSING GUILD FOR PARTICIPATION IN THE
PUBLIC IMPROVEMENTS OF MAX AVENUE WITHIN AND ADJACENT TO
LARKHAVEN CHULA VISTA UNIT 3
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between THE CITY OF CHULA VISTA, a municipal corporation, and AMERICAN
HOUSING GUILD-SAN DIEGO, for participation in the public improvements
of Max Avenue within and adjacent to Larkhaven Chula Vista Unit No. 3
dated the 27th day of March 1973 a copy of
which is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the sum of $5,100.00 be, and the
same is hereby authorized to be expended from Gas Tax 2107 Funds for
the purpose set forth hereinabove.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

Sari Diego, California 92123, hereinafter called "Subdivider";

WIiEF.EAS, Subdivider. has or is about to enter into an agreement
with t11e City of Chula Vista providing for the development of public
improvements in certain streets located within that certain subdivision
to be known as Larkh~iven Chula Vista Unit 3, and
WHEREAS, one of said streets located within the subdivision
is a street known as Ajax Avenue, and
4'HEREAS, approximately 85 feet of existing Idax Avenue, north-
erly of the 250 foot aide San Diego Gas and Electric Company easement
shall have to be reconstructed to provide for the continuation of Max
Avenue in a southerly direction, and
WHEREAS, a future City park is adjacent to Max Avenue on the
southerly portion of said subdivision, and
WHEREAS, subdivider is required,. pursuant
policy to construct full street improvements within
to pave a 28 foot right-of-way adjacent to the curb
streets, and the City accepts the obligation to rec

complete street improvements on Max Avenue fronting

WIiEREAS, it is generally accepted tlZat it is desirable to
construct the City's portion of said street concurrent with the installa-
tion of improvements by the-subdivider, and that, because of the ready.
availability of construction equipment and elimination of certain work
which is caused by stage construction, the work can be performed more
economically than if it were to be accomplished separately, and
WIiEF.EAS, the following advantages would apply if the City of
Chula Vista were to participate in the complete improvement of said
street known~as Max Avenue rather than subsequently improving said street
with a competitive bidding procedure:
1. Subdivider will be performing identical work immediately
adjacent to the portion to be paved by City, and consequently will have
all necessary equipment and personnel available without additional move-
in cost.
2. Subdivider can dispose of excavated material conveniently
within the adjacent lots, under construction, whereas if the work were
accomplished following completion of the subdivision it would be neces-
sary to haul such material to more remote disposal sites, resulting in
higher costs.

4 . The integrity, riding quality and aestl;etic ~ipl~carance of
a street is superior ~,~l~en all portions arc constructed as a single
project.
5, Unit prices applicable to large pro_ic>cts are generally
lower than those for smaller projects, therefore, in combining the
island paving ~•aith t}Ze paving of the remainder of the subdivision,
the subdivider is in position to perform the. work at the lesser rate
and to pass some of said saving on to City,
WHEREAS, it is agreed that the cost of.. said improvements
will be the same as the unit prices for the subdivision improvement
work being performed, plus five percent (5u) of said work for overhea~~.
WHEREAS, although precise structural sections have not been
determined at this time, and no cost estimate which is reasonably
accurate has been developed, it is anticipated that the total cost of
the City's participation will be approximately $4,700.
NOW, THEP.EFORE, IT IS MUTUALLI' AGREED by and between, the
parties hereto as follows:
1. Subdivider agrees to install such improvements, i.e.,
all improvements in P•Zax Avenue northerly of the San Diego Gas and Electric
easement between stations 5+90 and 6+74.39 as shown on Drawing No. 73-51D
and the improvements on the westerly side of the southerly 166.84' of
Max Avenue as shown on Drawing 73-49D, consisting of 166.84 feet of curb,
gutter, and sidewalk and a strip of paving 6,5 feet wide by 166.84 feet
in length.
2. City agrees to pay subdivider for said improvements in
an estimated amount of $4,700 based upon the following unit costs:
A. Max Avenue northerly of San Diego Gas & Electric easement:
Removal of curb and gutter: 168 L.F. .$3.00 L.F.
Removal of sidewalk: 700 S.F. 0.50 S.F.
Removal of asphalt concrete pavement: 2,772 S.F. 0.20 S.F,
Raise wa ter meters to grade: 2 each 50.00 Each
Raise ma nhole to grade: 1 each 100.00 Each
Replace driveway: 140 S.F. 0.60 S.F.
Replace sidewalk: 672 S.F. 0.50 S.F,
Replace asphalt concrete pavement & base: 2,772 S.F. 0.32 S.F.
Grading: 240 cubic yards 0.50 C.Y.
B. Max Avenue by park site:
Curb, gutter and sidewalk: 167 L.F. 5.00 L.F.
Asphalt concrete on approved base: 1,754 S.F. 0.32 S.F.
Grading: 98 cubic yards 0.50 C.Y.
3. Said proportionate share of the cost of said improvements
will be paid to subdivider, American Housing Guild-San Diego, upon
completion and acceptance of said improvements b1T the City of Chula Vista,
