RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA GRANTING THE APPEAL OF ROY F. ADAMS FROM THE
CHULA VISTA PLANNING COMMISSION DENIAL OF A CONDITIONAL
USE PERMIT FOR THE OPERATION OF A HALFWAY HOUSE AT
380 BROADWAY IN THE CITY OF CHULA VISTA
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, the City Council has heretofore, on June 5, 1973,
conducted a public hearing on an appeal from Mr. Roy F. Adams from the
Chula Vista Planning Commission denial of a conditional use permit
for the operation of a halfway house at 380 Broadway, in the City of
Chula Vista, and
WHEREAS, having heard all of the testimony on said appeal,
the City Council of the City of Chula Vista has determined that:
1. The proposed use as a psychiatric halfway house at
380 Broadway, is necessary and desirable to provide a
service or facility which contributes to the general
well being of the community, based upon the representations
made by doctors and hospital administrators within the
community and the fact that many of the residents will
be local Chula Vistans.
2. Such use will not, in accordance with the conditions
required herein, be detrimental to the health, safety or
general welfare of persons residing or working in the
vicinity or be injurious to property improvements in the
vicinity.
3. That all conditions of the Chula Vista City Code and
those specifically set forth herein will be complied with.
4. That the use allowed will not adversely affect the
general plan of the City of Chula Vista.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the appeal of Mr. Roy F. Adams from the Chula
Vista Planning Commission denial of a Conditional Use Permit for the
operation of a halfway house at 380 Broadway, Chula Vista, California,
be and the same is hereby granted subject to the following conditions:
1. A revised site plan and landscaping plan and irrigation
plan, incorporating the concepts of staff amended Exhibit A, shall be
submitted to the Planning Department for approval.
2. The 8 ft. high fence located near the south property
line shall be extended to the (west) rear property line. (A gate may
be provided if desired.)
3. The area lying west of the dining room shall be screened
from the dwelling units to the west with a 6 ft. high solid fence and
shall not be used for active recreational activities.
4. Complaints filed by nearby property owners, failure
to comply with the conditions of approval, or failure to properly
maintain the buildings, landscaping and surfaced areas of the site,
shall constitute grounds for review and possible termination of
PCC-73-13 by the Planning Commission.
5. In order to assure that Phase II will be carried out
as proposed, detailed plans involving landscaping, recreation areas,
building conversion, and parking plans shall be submitted to the staff
prior to implementation.
6. The number of patients shall be limited to a maximum
of two per unit.
BE IT FURTHER RESOLVED that the issuance of said conditional
use permit is also conditioned and contingent upon receipt and retention
of a license for this purpose issued by the State of California.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby authorized and directed to forward
a certified copy of this resolution to the appellant.
