Home My WebLink AboutReso 1973-6889RESOLUTION N0. 6889 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THE DECLARATIONS OF COVENANTS, CONDITIONS, AND RESTRICTIONS FOR OTAY AND LARKHAVEN PARK SITES, AUTHORIZING THE MAYOR TO EXECUTE THE SAME AND DIRECT- ING THE CITY CLERK TO RECORD THE DECLARATIONS The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that those certain Declarations of Covenants, Conditions, and Restrictions for Otay and Larkhaven Park Sites, dated the 12th day of June, 1973, copies of which are attached hereto and incorporated herein, the same as though fully set forth herein be, and the same are hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said Declarations for and on behalf of the City of Chula Vista. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to record said Declara- tions in the Office of the County Recorder of San Diego County. W I T N E S S E T H WHEREAS, Declarant is the owner of certain real property locat- ed in the City of Chula Vista, County of San Diego, State of California, described as: Lot "C" of Larkhaven Chula Vista Unit No. 3, according to the Map thereof No. 7590 filed in the office of the County Recorder of San Diego County April 2, 1973, which real property was acquired for park purposes with federal assistance under the Open Space Grant Program of the Department of Housing and Urban Development. NOW, THEREFORE, in accordance with the requirements of said Grant, the City of Chula Vista does hereby establish the restriction declaring that any sale, lease, mortgaging, or creation of other indebt- edness or other transfer of that site or any interest therein is subject to the prior approval of the Secretary of Housing and Urban Development.
