Resolution - Making application for detachment of "Nom's Third Avenue
Annexation" and 'Arizona Street 1911 Act Annexation" from the
Montgomery Fire Protection District

The City has been informed by the County Assessor that the "Nom's Third Avenue"
and the "Arizona Street 1911 Act" annexations to the City of Chula Vista must be
detached from the Montgomery Fire Protection District. Since more than one year
has elapsed since "Nom's Third Avenue" (October 5, 1973) and the "Arizona Street
1911 Act" (October 20, 1973) annexations were filed with the State Board of
Equalization, these detachments will have to be processed through LAFCO under the
provisions of the District Reorganization Act of 1965.
DETACHMENT PROCEDURES
The City must submit the following to LAFCO:
1. Petition for detachment
2. Consent to detachment
3. Detachment questionnaire
4. Resolution of City Council authorizing the detachment
FEES REQUIRED
The following fees will be required to process these detachments:
1. Recordation fee to State Board of Equalization
2. LAFCO processing fee

Financial Statement: Funds are available in City Clerk's budget account
01-1160-5202 to pay the required fees.
Commission-Board Recommendation: N.A.
Department Head Recommendation: Adopt the resolution making application for the
detachment of "Nom's Third Avenue" and the "Arizona Street 1911 Act" annexations
from the Montgomery Fire Protection District and authoriz staff to file the
detachment application with LAFCO.
City Manager Recommendation:
Recommend adoption. It should be noted that this action is necessary due to lapse of
the one-year deadline for notification which was missed in error. This error will not
recur as the processing method has been corrected. The City Attorney's office is
investigating the possibility of dual levy for the affected property owners, especially
as it relates to Fire Districts. If a dual levy occurs, the City should assume re-
sponsibility.
