[ 12 ] CHULA VISTA CITY COUNCIL MEETING oF: MARCH 20, 1973 ITEM TITLE: Resolution - Amending Resolution No. 4675 Establishing A Sidewalk Maintenance Policy in Accordance with The Provisions of Section 6510 of The Streets And Highway Code of The State of California And Section 27.2 of The Chula Vista City Code INITIATED BY: Director of Publ i c Works/City Engineer BACKGROUND The City Manager in a memo dated July 31, 1972, requested the Director of Public Works to review Resolutions 4675 and 6192 in regard to possible conflicts between the overlapping provisions of established policies in regard to maintenance of sidewalks and preservation of street trees. Resolution No. 4675 primarily concerns itself with the maintenance of sidewalks. It also assigns the responsibility to the adjacent property owner to prevent vegetation from growing in such a manner as to obstruct the street and/or sidewalk. This policy contains an implication that the property owner is responsible for trimming of City street trees. Resolution No. 6192 deals primarily with removal, replacement and plant- ing of City street trees. It further attempts to define responsibility for damage resulting from growth of City street trees. In order to eliminate any possible misunderstanding in the somewhat overlapping provisions of the two resolutions, the Division of Engineer- ing requested the City Attorney to prepare a resolution modifying existing policy so as to accomplish the following: 1. Clarify that it is the City's responsibility to trim City street trees so as to not obstruct the streets and sidewalks. 2. Establish that it is the property owner's responsibility to notify the City when City street trees adjacent to his property are in need of trimming. Establish that the City will bear the cost of repair or replacement of sidewalk where it can be shown that a hazardous condition is the result of City street trees. The City Attorney has prepared the requested resolution amending Resolution #4675 establishing a sidewalk maintenance policy in accordance with the provisions of Section 6510 of the Street and Highway Code and Section 2.7.2 of the Chula Vista City Code. ;~ i `'
