HomeMy WebLinkAboutReso 1987-13158 (c) RESOLUTION NO. 13158 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE SAN DIEGO RESIDENT RELATIONS FOUNDATION AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and the SAN DIEGO RESIDENT RELATIONS FOUNDATION, in regard to the expenditure of City funds appropriated, dated the 21st day of July 1987, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. FULASZ, CMC, CITY CLERK of the City of Chula Vista, California, DO HEREBY CERTIFY thot the above and foregoing is a full, true ond correct copy of RESOLUTZON N0. 13158 ,ond that the same hos not been amended or repealed DATED  CityClerk otv OF CHULA VISTA CC-660 AGREEMENT SETTING OUT TERMS AND OBLIGATIONS OF SAN DIEGO RESIDENT RELATIONS FOUNDATION IN REGARD TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED THIS AGREEMENT, made and entered into this 21.st day of July 1987, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter referred to as "City" and SAN DIEGO RESIDENT RELATIONS FOUNDATION, hereinafter referred to as "Grantee". WITNESSETH WHEREAS, the City is currently involved in a Community Development Block Grant program, a principle goal of which is to benefit low and moderate income persons; and WHEREAS, the Grantee is equipped and willing to provide certain services to the City which will primarily benefit low and moderate income persons and has the necessary expertise in this field for completing the same; and, ~HEREAS, the City is desirous of having those certain services, herei nafter enumerated, performed by the Grantee; and, I~HEREAS, funding for the Grantee is contingent upon receipt of a Letter of Credit authorizing a drawdown of Block Grant funds from the U. S. Department of Housing and Urban Development IHUD); and WHEREAS, no expenditure may be made out of any appropriation awarded such a Grantee unless an agreement has been reached between the parties setting out the terms and obligations for the expenditure of such funds. NOW, THEREFORE, in consideration of the mutual obligations of the parties as herein expressed, the parties hereto agree as follows: 1. The term of this agreement shall be for a period of one (1) year, from July 1, 1987, through June 30, 1988, unless further modified to include other permitted expenditures of funds that are appropriated by the City Council. 2. The administration of the Grantee agrees to expend City-appropriated funds to meet bona fide obligations incurred for staff costs, utilities, transportation, supplies and postage costs associated with provision of services to low income Chula Vista residents, for the period July 1, 1987, through June 30, 1988, for an amount not to exceed $6,000. 3. Payment of those City-appropriated funds shall be made to the Grantee in quarterly installments in roughly equal amounts following receipt by City of expense reimbursement claim forms from Grantee. 4. The Grantee shall maintain all financial records for three years following the year in which it was active. +o 5. In exchange for those City-appropriated funds, the Grantee agrees^expand tenant/landlord dispute resolution and housing information and referral services in Chula Vista in order to further benefit low income Chula Vista residents. Specifically, Grantee agrees to provide the following services during the time period of this contract: a. Hold discussions, make presentations and/or provide literature on tenant/landlord relations and other related rental housing issues at Chula Vista community centers, libraries, senior citizen service centers, apartment complexes, chamber of commerce, other civic groups and businesses. b. Make available to the Chula Vista Police Department, and present, if requested, videotapes and/or other materials to train Police personnel on tenant/landlord relations issues. c. Make available to the Sweetwater Union High School District and Southwestern College and present, if requested, lectures, literature and/or other educational materials on rental housing issues. d. Work in cooperation with the Chula Vista Fair Housing Officer on housing discrimination issues by referring inquiries on fair housing issues to said officer, when appropriate, coordinating presentations, discussions and negotiations on rental housing issues with Fair Housing Officer. 6. The Grantee shall provide the City with a quarterly report to include the following statistics relative to its clients: a. Number of Chula Vista resident clients served b. Gender of clients c. Annual gross income of clients' households Iby income category) d. Ethnicity of clients (White, Black, Hispanic, Native American, Pan-Asian) e. Types of services provided to clients and number of clients receiving each type of service f. Previous quarter's expenditures of Block Grant funds g. Progress accomplished in work areas specified in above item 5. -2- ~The statistics need not be collected for all clients, but must, at a minimum, be compiled for one normal operational day for each quarter of the period covered by this contract. 7. Performance of this agreement may not, by subagreement, be assigned to any other entity without prior written consent of the City. 8. The City, at its discretion may require the Grantee to provide or allow the City to undertake a complete financial and program audit of its records. Those records shall contain, at a minimum, the following information for each client surveyed: income, residency, gender and ethnicity. 9. The Director of Community Development, or his/her designated representative, shall represent the City in all matters pertaining to the services rendered pursuant to the agreement and shall administer this agreement on behalf of the City. 10. The President of San Diego Resident Relations Foundation or his/her designated representative, shall represent the Grantee in all matters pertaining to the services rendered pursuant to the agreement and shall administer this agreement on behalf of the Grantee. ll. The Grantee shall comply with Executive Order 11246, entitled "Equal Employment Opportunity," as amended by Executive Order 11375 and as supplemented in Department of Labor regulations 41 CFR Part 60. 12. The Grantee agrees to abide by the requirements of OMB Circular A-102, and specifically Attachment "0", Items 7 and 14. 13. The contract may be terminated or suspended by the City after 60 days notice to the Grantee due to default by the Grantee or the Grantee's inability to perform, regardless of whether such inability is due to circumstances wi thin or beyond the grantee's control. Settlement of any disputes shall be based on the laws of the State of California. 14. The parties reserve the right to pursue any remedy provided under California law for remedy in instances where contractors violate or breach contract terms. 15. The Grantee shall account for the use of Block Grant funds separately from other funds, so as to demonstrate that the funds are used for their designated purposes. 16.
