RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND THE CITY OF IMPERIAL BEACH FOR USE OF THE CHULA
VISTA ANIMAL SHELTER
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that that certain agreement between THE
CITY OF CHULA VISTA, a municipal corporation, and THE CITY OF
IMPERIAL BEACH, for use of the Chula Vista Animal Shelter
dated the 21st day of July , 1987, a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.

AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE
CITY OF IMPERIAL BEACH PROVIDING FOR THE USE OF
CHULA VISTA~B POUND FACILITIES ~ND SERVICES
THIS AGREEMENT, made and entered into this 21~t day of
July , 1987, by and between THE CITY OF CHULA VISTA, a
municipal corporation, hereinafter called "Chula Vista"~ and THE CITY
OF IMPERIAL BEACH, hereinafter called "Imperial Beach";
WITNESSETH:
WHEREAS, the City of Imperial Beach desires to use the pound
facilities of the City of Chula Vista as a shelter for the impounding
and disposing of dogs and small animals, and
WHEREAS, The City of Chula Vista has pound facilities
adequate to serve the needs of the City of Imperial Beach in addition
to the present use by the City of Chula Vista, and
WHEREAS, the City of Imperial Beach desires to enter into
an agreement with the City of Chula Vista for the use of the pound
facilities of the City of Chula Vista as a shelter for the impounding
and disposing of dogs and small animals~ and
NOW, THEREFORE, IT IS AGREED by and between Chula Vista and
Imperial Beach as follows:
1. Chula Vista agrees to permit the City of Imperial Beach
to utilize pound 'Facilities owned and operated by the City of Chula
Vista as shelters for the impounding and disposal of dogs~ cats and
other animals that are impounded in all portions of the incorporated
territory of the City of Imperial Beach (92032).
2. Chula Vista agrees to perform all normal pound services,
including among other things, the following:
a. Confinement, feeding, destruction and disposal of dogs
and small animals.
b. Use of euthanization by injection on a regularly
scheduled basis.
C. Reasonable use of the Animal Shelter offices and
facility.
3. Chula Vista agrees to provide pound facilities and
services at the Animal Shelter, 690 Otay Valley Road, between the
hours of 9:00 a.m. to 5:00 p.m., slx days a week, excluding holidays~
for the purpose of receiving animals from officials of the City of
Imperial Beach and for the redemption by owners, provided that owners
pay charges incurreO for the care of animals.
4. Chula Vista agrees to accept dogs or small animals from
bona fide residents of Imperial Beach without charge to such person.
>xThe hours ~or acceptance of such animals shall be Monday thru Saturday
~rom 9:00 a.m. to 5:00 p.m.
5. Animals brought into the Shelter will be euthanized if
they are not redeemed by their owners or adopted by new owners. In
any case, euthanasia will not take place any sooner than 72 hours
after the animal has been received. The only exception to the 72-hour
rule is the case of seriously ill or injured animals.
6. Retroactive to July 1, 1987 and extending through June
30, 1988, Imperial Beach agrees to pay the City of Chula Vista the sum
of ONE THOUSAND FOUR HUNDRED TWO DOLLARS AND TWENTY CENTS ($1,402.20)
per month for the aforementioned services and facilities. The Finance
Office of the City of Chuia Vista shall, as of the first day of each
month, credit Imperial Beach with the amount of monies received duriog
the previous month from Imperial Beach residents as fees for
redemption or adoption of Imperial Beach animals. To the balance of
funds remaining to be paid, a one percent (1%) service and billing
charge shall be applied. The Finance Officer shall submit the billing
to Imperial Beach on or before the 10th day of the month following the
billing period, and that amount shall be due and payable upon receipt
by Imperial Beach, but in no event later than the last day of the
billing month.
7. Chula Vista shall not be responsible to any resident of
Imperial Beach, or to the City of Imperial Beach, because of the
~estruction of any animal delivered to and accepted by the pound
facilities pursuant to this agreement, and the City of imperial Beach
agrees to hold harmless the City of Chula Vista from any claims
arising from damage or injury to animals belonging to residents of the
City of Imperial Beach and delivered to the Chula Vista Animal Shelter
facilities.
IT IS FURTHER AGREED that this amended agreement shall take
effect and be in full force on the first day of July, i987 and shall
terminate on the 50th day of June, 1988, provided, however, that
either party may terminate this agreement at any time be giving to the
other party written notice of intention to terminate ninety (90) days
following said notice.
IN WITNESS WHEREOF, this agreement is executed by the City
of Chula Vista acting by and through its Mayor and by the City of
Imperial Beach acting by and through its Mayor, the date and year
first hereinabove written.

Dear Mrs. Fulasz:
During the regular meeting of the Imperial Beach City Council held on
August 18, 1987, the members of the City Council considered and
subsequently adopted Resolution No. 3577 approving an agreement between
the City of Imperial Beach and the City of Chula Vista for the use ol the
Chula Vista Animal Shelter. A certified copy of Resolution No. 3577 and an
executed contractual agreement for the use of Chula Vista's pound facilities
and services is enclosed with this letter.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF IMPERIAL BEACH APPROVING AN AGREEMENT
BETWEEN THE CITY OF IMPERIAL BEACH AND THE
CITY OF CHULA VISTA FOR USE OF
THE CHULA VISTA ANIMAL SHELTER.
The City Council of the City of Imperial Beach does hereby resolve
as follows:
Section 1. The agreement attached hereto~ marked Exhibit "A", is
hereby approved and the Mayor is authorized and directed to execute said
agreement on behalf of the City of Imperial Beach.
PASSED AND ADOPTED by the City Council of the City of Imperial
Beach at a regular meeting held on the lgth day of August, 1997, by the
following vote, to wit:
