HomeMy WebLinkAboutReso 1973-6993RESOLUTION N0.6993 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA OPPOSING AB 2610 WHICH WOULD COMPLETELY NULLIFY ACCEPTED CONCEPTS OF ZONING AND SERIOUSLY ERODE THE POWER OF LOCAL GOVERNMENTS TO CONTROL LAND USE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, AB 2610 has been introduced requiring a City, whenever the fair market value of real property is decreased due to a rezoning, to pay the property owner the amount of the decrease if the owner files a claim, and WHEREAS, said Assembly Bill would in effect broadly expand the concept of eminent domain and require municipalities to make payment for property that is left in private use, and WHEREAS, said Bill would further severely restrict the power of the municipality to properly control land use and destroy the planning process since it would inevitably lead to the planning and zoning of land into the most restrictive zone on a wholesale basis, and would end in stability in land use control through the adoption of intelligent General Plans which would attempt to accurately and honestly project the growth of the City, and WHEREAS, AB 2610 is a totally one-sided Bill in that it grants compensation to property owners for so-called "down-zoning", but does not reciprocate to grant to the City monies for incor- porating property into higher classifications which increases the property value, and WHEREAS, zoning commentators have for many years debated the wisdom of "buying and selling" zoning, but always on the assump- tion that if it were to be done, there would be total reciprocity which is not included in AB 2610. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista for the reasons stated hereinabove does hereby urge the Legislature to reject AB 2610. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward a certified copy of this resolution to Senator James Mills, Assembly- man Wadie P. Deddeh and all other members of the San Diego County Legislative Delegation.
