RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA CERTIFYING THE RESULT OF THE EXAMINATION OF
REFERENDUM PETITIONS SUBMITTED REQUESTING THE RESCISSION
OF RESOLUTION NO. 6910 APPROVING THE GENERAL DEVELOPMENT
PLAN AND SCHEDULE OF THE SPORTS WORLD DEVELOPMENT, IN
ACCORDANCE WITH THE REQUIREMENTS OF SECTION 4051.3 OF
THE ELECTIONS CODE OF THE STATE OF CALIFORNIA, RECONSIDER-
ING SAID RESOLUTION AND HEREBY DECLARING ITS INTENTION
TO CALL A SPECIAL ELECTION TO BE CONSOLIDATED WITH THE
SPECIAL STATE-WIDE ELECTION TO BE CONDUCTED ON NOVEMBER 6,
1973, IN ACCORDANCE WITH THE PROVISIONS OF SECTION 4022
OF THE ELECTIONS CODE OF THE STATE OF CALIFORNIA
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council did on the 26th day of June, 1973,
adopt Resolution No. 6910 approving the General Development Plan and
Schedule of Sports World, and
WHEREAS, said Resolution was placed upon second reading on
July 3, 1973 and the effective date of said Resolution would be
August 2, 1973, and
WHEREAS, subsequent to the second reading and adoption of
said Resolution, a group of citizens, known as Citizens Concerned for
Chula Vista, commenced the circulation of a referendum petition, a
form of which is attached hereto, and
WHEREAS, the City Clerk upon receipt of said petitions has,
in conjunction with the Office of the Registrar of Voters of the County
of San Diego, examined said petitions and has certified that said
petitions contained at least 3,297 valid signatures, in excess of the
requirements of Section 4051 of the Elections Code of the State of Calif-
ornia requiring that not less than ten percent (100) of the voters of
the City according to the County Clerk's last official report of regis-
tration to the Secretary of State, which is the amount of 2,921 signatures,
be affixed to said petitions, as indicated by the certification of the
City Clerk of the City of Chula Vista attached hereto and incorporated
herein by reference as if set forth in full, and
WHEREAS, the City Council in accordance with the requirements
of the Elections Code of the State of California, having reconsidered
the action in the adoption of Resolution No. 6910 approving the General
Development Plan and Schedule of Sports World, a copy of which is on file
in the office of the City Clerk, does hereby determine that a special
election should be called for the purpose of determining, in accordance
with Section 4052 of the Elections Code of the State of California,
whether a majority of the voters voting on the ordinance vote in favor
of it, and
WHEREAS, it is noted that a special state-wide election has
been called for the date of November 6, 1973, which date is less than
thirty (30) days from the earliest possible date when a special election
for the purpose of considering the resolution on the Sports World Project,
and

WHEREAS, reading Sections 4052 and 4053.1, read in pari
materia, would direct that in the interests of affecting savings to
the taxpayers that said elections be consolidated.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby declare its intention to call a special
election for the purpose of presenting to the people the question of
the rescission of Resolution No. 6910, adopted by the City Council on
the 3rd day of July, 1973, which ballot proposition shall, in accordance
with the requirements of Section 4052 of the Elections Code seeking
the approval of the majority of voters on the ordinance or resolution
in question, be stated generally as follows:
"Do the people of the City of Chula Vista approve
Resolution No. 6910, adopted by the City Council
on the 3rd day of July, 1973, adopting the General
Development Plan and Schedule for Sports World?

BE IT FURTHER RESOLVED that the City Council shall order said
special election to be consolidated with the Special State-Wide Election
to be conducted on November 6, 1973, in accordance with the requirements
of Section 4022 of the Elections Code of the State of California.

CERTIFICATION
I, JENNIE M. FULASZ, City Clerk of the City of Chula Vista,
California, do hereby certify that on the dates of July 12,
17, 24 and 30, 1973, I received a total of 422 petitions
for referendum on the Sports World issue, and subject
petitions contained a total of 5,016 signatures.
Verification of the signatures began on Friday, July 27, 1973.
Section 4051 of the Election Code states that the petitions
shall be signed '"by not less than 100 of the voters of the
city according to the county clerk's last official report of
registration to the Secretary of State..." The last report
made to the Secretary of State by the county clerk was on
December 13, 1972 which stated that Chula Vista's registered
voters totalled 29,206. Therefore, 2,921 verified signatures
were needed.
I hereby declare that of the first 330 petitions checked,
a total of 3,297 signatures were verified.

CERTIFICATE TO REFERENDUM PETITION
I, CHARLES J. SEXTON, Registrar of Voters in the County of San Diego,
State of California, hereby certify that the attached referendum
petition was delivered to this office by the City Clerk of the City
of Chula Vista, California, for checking.
I further certify that this petition consists of 414 sections. The
petition contains signatures and dates purporting to be respectively
the signatures of qualified electors of said City and the dates upon
which such electors had respectively signed said petition; that
attached to said petition at the time the same was filed as aforesaid
was an affidavit purporting to be the affidavit of the person who
solicited the signatures thereon; that the person by whom said affi-
davit purports to have been taken and verified was at the time thereof
an officer authorized to administer oaths; that therein affiant stated
his own qualifications, that he had solicited the signatures upon said
section, that all of said signatures were made in his presence and
that to the best of his knowledge and belief each signature to the
said section was the genuine signature of the person whose name it
purports to be.
That I examined the petition and the affidavits of registration in this
City current and in effect to determine therefrom what number of quali-
fied electors signed said petition; that 330 sections of the petition
were examined containing 4,101 total names and that 3,297 qualified
electors of this City had signed the petition.
I further certify that the total number of registered voters residing
within the incorporated area of Chula Vista, as certified to the Sec-
retary of State on December 13, 1972, was 29,206.

We request the said City Council to reconsider said legislative act and rescind the same, or submit
the same to the voters at a special election called for this purpose.
