WIiER}~AS, one of the steps in the procedure to amend, this contract '' is the adoption
by the legislative body of the public agency of a resolution giving
notice of its intention to approve an amendment to said ~antract, 1•rhich
resolution shall contain a summary of the changes proposed in said con-
- tract; and
~~'EiERLAS, the following is a statement of the proposed change:
Contracting agencies may amend their contracts under the provisions of
sB 37, Chapter °1, Statutes of 1°73, to redefine the definition of local
policemen and counter peace officers to permit all persons assigned to
identification and co,.munication duties~in the police department or a
sheriff's office t~~ho are not notir local safety members anc~ who were in
such employment on August k, 1972, to elect safety membership on or before
September 2g, 1973•
WHEREAS, the cost of such change for the public agency Vrith both Miscellaneous
and•safety categories of me:~bership can be estiriated by ajpplying the
difference betti•reen the public agency's contribution rate ',for its safety
- ta~mbers and its contribution rate for its miscellaneous rlembers to the
covered payroll of the members affected by this amendment.
1r7HEREAS, •the cost of such change for the public agency zrith only the safety category
of membership can be esti:.ated by applying the public agancy's cortribu-
tion rate for safety me; :hers to the covered payroll of tlYe emplo3*ees

You may recall that 1972 lenis7.ation (Chp. 560, Stats. of 1972) effective'' August L,., 1~7?, and

perform identification and communication duties except males in such emplpyment who elected to
be safety members within a prescribed period of time.
This year urgency legislation has been eracte~d (Chp. 9i, Stt~.ts. of 1973 -~',S.B. 37) operative
July 1, 1973, which twill permit any of the same contracting agencies to pjrovide safety member.
.benefits, subject to individual election; for el ~ c;rapJ.oyees of police or sheriff' s det~srtments
performing identification or communication duties if they are not already'safety members.
The conditions which must be met to make this possible are as follows:
1. The contracting agency must amend it's contract with the System and the ordinance apnrovina
this amendment must result in an effective contract amendment date no~later than September
2g, 1973.
2. After filing a timely Resolution of Intention, each agency must give eligible identific^t:i.or
and com~cunication employees an opportunity to elect to become "policemen" for retire;nent
purposes and return his election form to P.E.R. S. no )_ater than ~/28/'~3.

3. Each eli.gi_ble member who does so elect must be prepared to make arrea~•s cortributions at; the
higher safety member rates, either in a lump sum or by payroll deduct~.ons.
l~.. The employing agency must accept. the liability for the higher benefits provided for these
employees. ~ ',

first step if your agency wishes to amend its contract. ide want to stress, that unless the
contract a!~endment is effective by September 28, 1973, employees in such ~ontracti_ng agencies
may not elect to beccn;e local safety members. Your governing body should ''return one complete
executed set to this S,ys~%em if the enclosed Resolution i.s adopted..
Upon timely receipt of the erecu.t;ed Resel.ution of Intention, this System ~ri11 "forward an ordinar
authorizing; the proposed contr~.ct amendment, together with election forms and explanatory letter
for the el i_gible'members. Those agencies (cities and counties) that requ~re 30 dtiys for the
ordinanco -i;o become effective must adopt the ordinance r_o later than August 29, 1973, so that tY
amendment t~ri.ll he effective by September 28, 1973. (Emergency ordinances ', are not acceptable. foi
contract amend:~ent purposes.)
