RESOLUTION NO. 6952
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHU,LA
VISTA SUBMITTING APPLICATION FOR EXCLUSION OF CER~I'AIN
PROPERTIES FROM THE PERMIT CONTROL ZONE AS ADMINISTERED
BY THE COAST REGIONAL COMMISSION OF SAN DIEGO ARE,
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, on November 8, 1972, the people of CalifCprnia
approved an initiative establishing the Coastal Zone Conservation
Act, and
WHEREAS, Section 27104 (c) of said Act authorizes the San
Diego Coast Regional Commission to exclude stabilized urban 'land from
the permit control zone, and
WHEREAS, the City of Chula Vista has studied the permit control
zone within its jurisdiction and found that (1) the area east of Inter-
state Freeway 5 bears no relationship to the coast line and '(2) that a
large portion of that area contains stabilized urban zonin
g districts, and
WHEREAS, said stabilized areas are delineated in E~thibit "A"
entitled Request for Exclusion of Area From the San Diego Coast Regional
Commission Permit Control Zone, dated July 9, 1973, attached hereto and
incorporated herein by reference as if set forth in full, and
WHEREAS, it would be in the best interest of the people of
Chula Vista to exclude a stabilized area from permit control, and
WHEREAS, the exclusion of said area would reduce thie admini-
strative workload of the San Diego Coast Regional Commission in an area
that is stabilized and bears no relationship to the coast.
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
City of Chula Vista hereby requests exclusion from the permit control
area of the Coastal Zone Conservation Act Permit Control Zone within
the City of Chula Vista as outlined in the attached Exhibit "~,".
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby authorized and directed to forward
certified copies of this resolution to the San Diego Coast Regional
Commission.

COAST REGIOPdAL COMMISSION PERMIT CONTROL ZONE

Section 27104 (c) of the Coastal Zone Conservation.Act provides
for the exclusion of certain areas from the permit area. This section is quoted
below: ~ '
"Any urban land area which is (1) a residential area zoned, stabilized,
and developed to a density of four or more dwelling units per acre
on or before January 1, 1972; or (2) a commercial or industrial area
zoned, stabilized and developed for such use on or before January
1, 1972 may after public hearing, be excluded by the Regional
Commission at the request of a city or county within which such
area is located. An urban land area is "stabilized" if 80% of the
lots are built upon to the maximum density or intensify of use
permitted by the applicable zoning regulations existing on January
1, 1972.
Tidal and submerged lands, beaches and lots immediately adjacent to
.the inland extent of any beach or of the mean high tide line where
there is no beach shall not be excluded."
In. accordance with the above provision of law, the City of Chula Vista hereby
requests the San Diego Coast Regional Commission to exclude from the Permit
Control done, described portions of the City.
In deriving the area to be so excluded, reference has been made to
letters from the Office of the Attorney General to the Executive Director of the
Coast Regional Commission of June 4, 1973; to the Chairman o'f San Diego Coast
Regional Commission of April 4, 1973; and to the Executive Director+of the
California Coastal Conservation Commission of April 6, 1973, In essence, the
criteria so derived and utilized in preparation of the request are as follows:

1) That Section 27104. (c) does not allow exclusion of the Sin Diego
Unified Port District, or any portion thereof.
2) Lots immediately adjacent to the inland extent of any beach or mean
high tide line where there is no-beach shall not be excluded.
3) Residential densities of less than 4 units/acre cannot be considered
for exclusion.
4) Areas zoned for flood control cannot be excluded from permit
requirement.
5) The appropriate area to consider under Section 27104 (c~ is a zoning
district (effective as of January 1, 1972).
6) For the purposes of analysis a zoning district consistslof all
parcels under like zoning restrictions that share contiguity
through common boundaries or frontage or the same street
7) The boundary of the excluded area should correspond directly to the
boundary of the appropriate zoning district.
8) Only that portion of the zoning district within the perr~it area
should be considered in determining justification for exclusion.

9) If a single parcel of land occupies two zoning district$ each
' portion of the parcel within its respective zoning district should -
- be considered as a separate parcel. •
10) Where certain parcels cannot be excluded due to their constituting
tide lands or parcels immediately adjacent thereto, there auto-
matically included areas should not be considered as pant of the
zoning district.
11) If a parcel contains a non-conforming use which predate$ the zoning
ordinance and the non-conforming use is more intensive, then the use
can be counted toward the 80%.
12) When parcels are split by the 3000 foot line, all parcels touching
the permit line will be counted with -the respective districts.

The area far which exclusion is requested is; that part of the
City of Chula Vista falling within the Permit Control Zone, including the
commercially zoned districts focused on Broadway; the residential, cgmmercial
and industrial areas bounded by the limits of the permit zone on the !,east,
Flower Street on the north, Arizona Street on the south and Freeway ~-5 on the
west; plus the area of the Harborside Elementary School, and the utillity and
railroad property adjacent thereto. The limits of this area are depicted on
Exhibit A, which shows the limits of the exclusion area requested and, the land
uses therein as of January 1, 1972. Exhibit B depicts the limits of ~!he Permit
Control Zone, and the zoning in effect as of January 1,.1972. Also s~,hown on
Exhibit B are the identification numbers of the zoning districts keye~d.to the
worksheets prepared for each zoning district within the study area. ~fhe work-
sheets are appended as Exhibit C. Exhibit D is a summary sheet indicating
for each zoning district: (a) the number of land parcels within the zoning
district; (b) the num!~cr of land parcels developed to the maximum•allptti~able
density/intensity; and (c) the percentage of the parcels within the zoning
district which have been developed to the maximum allowable intensityydensity.
The area included in the proposed excluded area includes'1368
parcels, of which 1253 (91.6%) (1) are urban land, (2) are built upon (3) .
have four or more dwelling units per acre, and/or (4) are at least 80% developed
to the maximum allowable density/intensity. ~.
It may be noted that some zoning districts requested forlexclusion
to not appear to meet the requisite criteria.- The rationa le for the request
for the total area is as follows:
(a) Twenty-one zon ing districts fully meet the developjment
criteria.
(b) Three zoning districts do not fully meet the criteria, how-
ever, in all cases they are; (1) completely surrounded by fully qualifying

zoning districts; (2) 50% fully developed In area notwitf~standing that the
percentage of parcels fully developed are only 20%, 25% and 50%; (3) very small
in area, having only 5, 6, and 4 parcels respectively.
(c) Five zoning districts do not fully meet~but are generally
•
in keeping with the spirit and intent of the Act. Two of the districts are
between 70% and 80%, and a third is 66.7% fully developed. The remaining t4vo
are 37.5% and 52.6i' respectively. Ho~rever, all of these areas are essentially
:tabilized wf~en the area is considered, rather than number of parcels. In all
cases, (1) the greater portion of 'the area is fully developed; (2) the zones
are contiguous to fully developed zones; (3) are essentially stabilized in
current land uses. For instance, one zoning district is a long established
strip commercial area (74%); another is a single large manufacturing plant
occupying 3 parcels, while the parking facilities for the plant are fragmented
into 5 separate parcels, including an old single family dwelling (3~.5%), and
in a third instance a large area of large parcels is occupied by the R-3 zoned,
multiple family use, while in one corner remain 16 parcels of two-family
dwellings (70'.4%).
In consideration of the total area requested, it is the position of
the City, that the area is stabilized, in a long established area oi• the City.
It is compact and readily defined; and is in keeping with the .inteni~ and spirit
of the Act,~in that it is well separated from immediate bayfront impingement
by the two railroad rights of way, the freeway, and a large industrial complex
extending virtually the entire length of the two mile extent of the area requested.
The commercial area previously discussed which is only marginally qualified is
approximately one mile from the current extent of actual bayfront, clearly
beyond the scope envisioned in the Act.
