E,947 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CH,jULA VISTA AND THE SPRING VALLEY SANITATION DISTRICT F~R EXEMPTION FROM CONNECTION CHARGE, HARBOR DRIVE-IN!,THEATER AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMEI~TT The City Council of the City of Chula Vista does Npereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain aggreement between THE CITY OF CHULA VISTA, a municipal corporation, ar~d the SPRING VALLEY SANITATION DISTRICT for exemption from confection charge for the Harbor Drive-In Theater, dated the ~ err day of which is attached hereto and incotrporated herein, the same a~ though fully set forth herein be, and the same is h 19~-~ a cppy of ereby approved. BE IT FURTHER RESOLVED that the Mayor of the City a'f Chula Vista be, and he is hereby authorized and directed to execute'said agreement for and on behalf of the City of Chula Vista. DATED ~ and that the same has not e City Clerk AGREEMENT FOR EXEMPTION FROM CONNECTION CHARGE This Agreement made and entered into by and between the CITY OF CHULA VISTA hereinafter referred to as "C~.ty", and the SPRING VALLEY SANITATION DISTRICT, hereinafter referred to as "District". W I T N E S S E T H: WHEREAS, District constructed the Spring Valley Outfal~l Sewer in 1964 to serve areas both inside and outside of t District• he and WHEREAS, City agreed to pay a connection char Per gross acre for ge of 5130.00 properties served by City's sewer system and connected to the District's outfall sewer; and WHEREAS, The property known as the Harbor Drive-In Theater at National Avenue and "D" Street is connected t City sewer and to District's outfall sewer on a © the basis onl temporary y; and WHEREAS, City desires an exemption from the aforementi connection charge on the basis that the Harbor Drive-In T °ned property will b heater e d?-s^onr_ected from .-~, ..~ ~.+e D'str~ct's sewer within 12 months of com letion of y out~ail P a trunk sewer on the north side of Route 54 Freeway; NOW THEREFORE IT IS MUTUALLY AGREED AS FOLLOWS: 1. The Harbor Drive-In Theater property may be conne to District's outfall sewer without ~ted payment of the connection a-~r~ charge of $130.00 per grass acre. 2. Said property shall be disconnected from District's outfall sewer within 12 months of completion of the prpposed trunk sewer. IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date first above written.
