HomeMy WebLinkAboutReso 1973-6934Form No. 342 Rev. 9-71 RESOLUTION N0. 6934 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE COUNTY OF SAN DIEGO FOR THE EMERGENCY EMPLOYMENT PROGRAM AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT' The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and THE COUNTY OF SAN DIEGO for the Emergency Employr~lent Program dated the 10th day of July , 1973 , a copy of which is attached hereto and incorporated herein, the same a~ though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. E?~iPLOYr~~EF~T PROGRAR4 (PEP COMPLETION) THIS AGREEMENT entered into this day of , 19?3 by and between Chula Vista City , hereinafter referred to as "SUB-GRANTEE" and the COUNTY OF SAN DIEGO, hereinafter referred to as "COUNTY" WITNESSETH: WHEREAS, County has been granted °unds by the Federal Government under the Emergency Employment Act of 1971, and; WHEREAS, County is required by said Act to allocate the granted funds eq*.:itKbly amcs:ig other public age sci4s ~? n i San Diego County which desire to conduct employment programs under the Act, and; WHEREAS, Sub-grantee is such a public agency and desires to conduct an employment program under the Emergency Employment Ac t of. 1971; NOS9 THEREFORE IT IS AGREED AS FOLLOj9S: I. For the period commencing November 1, 1971 and ending no later than June 30, 1974, Sub-grantee hereby agrees to conduct an employment program to provi.le unemployed and underemployed persons with employment ~~herein they will provide needed public services. No expenditures are to be .----~ l~ C%~ -' , made or liability incurred after June .3G, 197d. If such ,. occur the County assumes no obligations. In furtherance of said employment program, Sub-grantee shall employ persons as specified in its Expenditure and Employment Plan which is attached hereto and by this reference incorporated herein. In conducting said employment program, Sub-gra.itee shall comply with all requirements, provisions, terms, and conditions of the Emergency Employment Act of 1971,~Fublic Law 92-54; the regulations pursuant thereto; the guidelines of the Secretary of Labor of the United States related thereto; and the grant conditions agreed to by E;ounty in securing initial and full funding under said Emergency Employment Act of 1971, including, but not limited to, those requirements, provisions, terms, and conditions respecting selection of participants, use of federal funds, non-federal share, record keeping and reporting, compensation and working conditions of participants, aad non-discrimination. A copy of said Emergency ~nployment Act of 1971, and copies of the regulations and guidelines pursuant thereto, have been previously provided Sub-grantee. In the event the Act or the regulations or guidelines pursuant thereto are amended at any time subsequent to the date of this Agreement, the Sub-grantee shall comply with them as amended, or shall notify the County within 20 working days after receipt of the amendments that :.t cannot so conform, in which case, this Agreement shall terminate in accordance with the applicable regulations. -2 - " . /~' ~ ,. ~`~ ~%~,~ 2. For Sub-grantee's conduct of~the employment pro ,ram specified in Paragraph I of this Agreement, County shall grant to Sub-grantee the sum of $ 53,188 on or before June 30, 1974 Said sum is to be spent by Sub-grantee in•the conduct of its employment program in accordance with the Expenditure and Employment Plan and projected funding ceilings and by this reference incorporated herein. Any of the above funds remaining unspent at the end ` of the period specified in Paragraph 1 of this Agreement or at the close of the Sub-grantee's program, shall be returned to the County within 30 days by said Sub-grantee, along with the final financial report. 3. San Diego County b7anpower Division (PEP) shall administer and monitor performance of this Agreement on behalf of the County and-shall at all times have the right to inspect, ~ monitor and evaluate the employment program of Sub-grantee .pursuant to this Agreement. 4. If anytfunds are expended by Sub-grantee in violation of the Act, the regulations, the guidelines, or grant conditions, the County may make necessary adjustments in payments to Sub-grantee on account of such unauthorized or illegal expenditures. County may draw back unexpended funds which have bE~en made available in order to assure that .they will be used in accordance with the purposes of the Act or to prevent further unauthorized or illegal expenditures, and -3 _ a /} J `C/~ s`' County may withhold funds otherwise payable under the Ac•t in order to recover any amounts expended ilXegally or for unauthorized purposes. If no further payments would otherwise be made under this Agreement, the County may request a repayment of funds used for unauthorized or illegal expenditures, and within 30 days after receipt of such request such repayment shall be reads. 5. Termination When the grant to the County under the Emergency Employ- went Act of 1971 is terminated by'the Federal Government in whole or in part for any reason whatsoever, the County may terminate this Agreement in whole or in part. If Sub-grantee violates the Act, the regulations, the guidelines or grant terms or conditions specified in Paragraph 1 of this Agreement, the County may terminate this Agreement in whole or in part unless Sub-grantee causes sucn violation to be corrected within a period of 14 days after receipt of notice from County specifying the violation. Either party may execute cancella- tion of this Agreement by 30 days advance written notification of such intent. Termination shall be effected by a notice of termination which shall specify the extent of termination and the date upon which such termination becomes effective. Upon receipt of a notice of termination, Sub-grantee shall: (I) Discontinue further commitments of funds to the extent that they relate -4- ~/ ~ ,C/ to the terminated portion of the Agreement ~ (~') PromptlSr . Banc®1 ail agreements, and coni;xacts utilizing funds under •--..., this Agreement to the extent that they relate to the terminated • portion of the Agreement; (3) Settle, with the approval of the County, alI outstanding claims arising from such termina- tion; (4) Submit, within six months after the receipt of • the notice of termination, a termination settlement, proposal which shall include a final statement of •aIl unreimbursed costs related to the terminated portion of thi:~ Agreement, •but in case of termination for violation of this Agreement ' by Employing Agency, the cost of preparing the settlement proposal shall not be reimbursed to Employing Agency.
