ITEM TITLE: Resolution - Approving Agreement for Deferral
Improvements at 435 James Court-

On March 19, 1973, the Planning Commission granted a defe~ral of public
improvements at 435 James Court in conjunction with an ap lication for
a building permit. i
Justification for the deferral was based upon the fact th t no improve-
ments existed on the north half of James Court and becaus of a pending
formation of a 1911 Act Improvement District for the whol length of
James Court. Three other properties on the north side of James Court
presently have deferrals. Together with this property, t ere will be a
total frontage of 258 feet of deferred public improvement The total
length of James Court is approximately 538 lineal feet. he south half
was developed by the developer of Cindy Park Unit No. 2 S bdivision.
The Planning Commission action was conditioned upon posti
guarantee in the amount of $2,500. The property owners h
execute a lien agreement to serve as a performance guaran
necessary that the City Council approve such agreements.
approval of the agreement will be followed by recordation
in the office of the County Recorder.
