City 0~ C~nu OFFICE OF THE CALIF CITY ATTORNEY I OPINION OF COUNSEL TO ACCOI~4PANY CONTRACT FOR GRANT TO ACQUIRE OPEN-SPACE LAND The Honorable Mayor and City Council of the City of Chula Vista 276 Fourth Avenue Chula Vista, California 92012 Dear Gentlemen: CU~sta I have examined the proposed Contract for Grant to Acquire pen-Space Land (herein called the "Contract"), identified as Contract No. OSC-456(G), to be entered into between yourself and the United States o America. I have also examined the two counterparts of the Contract. I have further examined that certain Resolution adopted by ou on the 24th day of July, 1973, wherein the execution of the Contra t was author- ized. I have made appropriate inquiry and I am satisfied that sai Resolution is still in full force and effect, that there is no pending or threatened litigation (either in Federal or State courts) challenging our authority to enter into the Contract, and that no legislation (either State or local) has been enacted which affects your power or authority to e~ter into the Contract and carry out the Program set out therein. I am, therefore, of the opinion that you are authorized to nter into the Contract, that it has been executed as authorized by sa'd Resolution and by law, and that, when the Contract has been executed b the Govern- ment, it will constitute a valid, binding, and legal agreem nt between yourself and the Government. !, ~-- -. ,, 'F r ~ ~~ George D.' ~ ind "erg, City Att rney ~,.
